I received a call yesterday from Kathleen Kerr of the States Predisposition Services office. Platinum B Services wants to bring a civil suit against me for defaulting on my loan. I borrowed $200 from them back on 10/28/05 and over the next 10 months paid them a total of about $1500. According to the lady I spoke w/ it doesn't matter. Anyway, I settled out of court for $430.00 and am paying half today and the other half in two weeks.

I received a call from the same number, but a different person, Hilary Romano. I haven't called her back yet. I'm afraid to. I can't afford to settle another defaulted payday loan account now since I'm trying to pay the Platinum B one. Yes, I'm afraid to not call her back if I'm going to be sued.

What should I do?

Guest, before you do anything, please list what state you are in , who you borrowed from, how much you borrowed from each and the total of how much you have paid to each. By settle out of court, did you settle with the collection agency? Also, could you list the phone number they are calling you from.

Guest, if this is a collection agency collecting for platinum b services, you need to be sure that they are not scamming you before you pay them. You do have a legal right to request they validate this debt in writing to ensure they are truly who they say they are and to ensure they are in fact collecting on a legal debt. I would send them a letter requesting debt validation before I paid them any $$. Please post the information I asked for so we can help you with this.

If I'm not mistaken (and correct me if I am wrong), Platinum B is not even licensed/legal, correct? And for a $200.00 loan, you had paid a total of $1,500.00? Then you settled with them for another $430.00? So, in all actuality, you will have paid them $ 1,930.00 for a $200.00 loan? If I am correct in the fact that Platinum B is not licensed/legal, they certainly would not "take you to court". Please let us know where you reside and exactly what the situation is. You're already going to send them 1/2 today and the other 1/2 in 2 weeks. I hate to see you send in more money after paying $1,500 for a $200 loan.

This is the perfect candidate for sending the pdl letter (or a debt validation letter if they are dealing with a collection agency), and filing complaints with the BBB, the FTC, and their state AG. That amount of money is complete robbery. And, am I correct? I do so believe that Platinum B is part of SSM/SMJ or whatever they call themselves today - which would not be licensed/legal? The amount of pay back alone ($1,930.00 for a $200.00 loan) tells me these people are not licensed......

I have been receiving calls from a Hilary O'Oneil. she has threaten to file suit against me for stolen money on a pdl that i took out for 200.00 in july of 2006. i live in NC does anyone have any advice for me

This "collection agency", if you can call them that, is close to being shut down by Florida's AG.

Do not pay them a dime. They have probably threatened you. They are the ones breaking the law. You need to file complaints against them immediatly.

Also, if they don't stop calling, file a police report for harrassment.

File a complaint with your state's Attorney General, your state's Dept of Financials, the BBB, the Florida Attorney General, the FTC . . . .

Next time they call tell them that you have called the police and filed a report for harrassment, and that all calls will be recorded and traced. Eventually they will stop calling . . . .

the calls have started again from state predispositon services hillary o'neil said that a shela hunt will be sending me a validation letter via e-mail. she also wanted to know if i could pay anything on the loan. i contacted fsm a few months ago to see if i could pay the original amouunt of $200.00 they told me i had to deal with these people. i was advise not to own up to the debt and that after 3 years that there wasn't anything anyone could about it. i told ms. o'neil that if she did not hear back from me that she would be hearing from my lawyer. well legal aide does not make those kind of call they can only give advise. can anyone help me out?

mclauriney, I would not be in any hurry to worry about paying them. First you need to be sure that the debt is validated properly. BEing a pdl, it is entirely possible they can not validate. IF you sent them a request for debt validation and have put in the letter a cease and desist contact clause, they should not be calling you. You have received nothing from them as of yet. Also, if you sent them a request for debt validation and they are responding, they should be sending you alot more than just a letter.

Did you send a pdl letter or a request for debt validation? If you sent the pdl letter and not a request for debt validation (debt validation letter - dv) I would advise you do so asap. They are a collection agency and thus, they have to follow certain laws. A DV letter is not an admission of owing the debt but a request for information regarding the debt. This will also stop the phone calls. You can fax this and follow up with a letter sent certified return receipt. If you need a dv letter let me know and I will pm it to you.

borrowed 200.00 in 2006. got a call from states predisposition, said i owed 561.00. i paid 270.00 that day, told them i would not pay anymore after that, they took 271.75 out of my account again.

:evil: I just sent an email to these people in regards to my account and said the following to Dustin Dernier-I have been dealing with your company for some time. I had a loan for 500 and paid it off successfully, I had a loan I think for $300 and paid it off successfully, $100 same thing. I have a $250 dollar loan I have had since 10/22/07 that I have paid about $675 in just fees-I did try several attempts to pay off, by sending emails to your staff I have sent faxes then I got a little lax and just thought I could go a little longer. I then have a problem with my bank account and I have to close it. I sent a fax on 3/4/08 revoking anyone who had ACH payments coming out of my account that I was revoking authorization and that they needed to contact me for further discussion to this matter-everyone was wonderful and gave me time and setup arrangements because they all know I am good with my accounts and I jumped on this before my due dates. I get a call from Nikki Walker stating that she revokes my revocation. I said I have been a good cu stomer and that I just want to push the date out and send either a prepaid credit card or money order in the amount of $250 +75, or make arrangements to pay it down. She says send something from my bank showing fraud-my bank is still monitoring and it has more information than I feel safe to give out. She says to send it no later than Thursday. I did get a little perturbed. I had my account closed and now have to wait until next week to open a new one since my direct deposit has stopped. If I have to abide by my loan and note disclosure then you guys would owe me money-see the attached it states my apr is 0.00%. I have the computer copy and I have the signed copy with the fax confirmation. Please call me to discuss this further and let me know what I can do.


Anyone that has a loan out with them close your account-go talk to your branch manager-send a fax to SJM Marketing/Platinum B Services and revoke their authorization as well as their affiliates-Federal Regulation E-for the consumer, look at my previous blog above and you will see why. I actually think they do this to people after they have carried a loan for over a few months. Platinum B Services is who you think you get the loan from-which is true, then your account states it was withdrawn by SJM Marketing same company(PO Box #-probably where the cronnies get paid and no one sees and it probably is also a place where all of our contact information-account #'s u name it go) when it gets tough for them they open up a new one and people have stated that United Federal Bank is a collection agency-which is also Platinum B Services. They deny this but the are so full of it. Well I do have to say I love cut and paste. The idiot who did my loan and note disclosure stated my APR%0.00 and any of my documents that I have received from them all have different APR% for the same loan. I am so mad at this point -bring the Collection agency on now. I think we need to do a civil lawsuit-I am in NJ.
