I've spoken with an attorney today and I am expecting a return call to see if he will handle the case.

When I was in school we were not allowed to leave school grounds at lunch because the schools insurance would not cover it if we got hurt. Do they no longer carry insurance?

If you slip and fall because there is water on the floor next to a drinking fountain...that's negligence and your health insurance regardless of where you bought the insurance...shouldn't have to cover it!!!!

She told me that the school will not cover it that if i had purchased the insurance then it would have covered it. I haven't heard back from the attorney yet I hope to hear from him today if he will take the case on because I am getting more mad sitting here thinking about it.
He wasn't even running when it happened. All I want the school to do is pay the bill and put out mats or signs near the bathroom for the water or to tell kids to excercise caution when walking there.

The school would definitely have some sort of contingent liability just by virtue of the fact that they did not exercise due diligence in keeping the floors dry.
Imagine if your landlord didn't put salt on the stairs outside, they iced up, and you slipped down the stairs because of it. Do you have to buy insurance from the landlord to protect against his own negligence? The answer is no.
I think this lady's response is just the school's 'first line of defense'. 8 out of 10 people would probably just accept her excuse and drop it. But the sqeaky wheel does get the oil. Keep at it and good luck!

Sounds like another way for the schools to wring a little more money of the students and their parents. When did Schools become a profit center? If schools in this country would spend a tenth of the time educating as the do worrying about being PC and extorting money, it is amazing how far ahead of the rest of the world our kids would be.

Definately call an attorney. I'd be worried about my kid being sent to a school where it's ok for them to have a slippery puddle on the floor where they can fall and hurt themselves and the school is not responsible.

For me I am up in the air on if I should go after the school or not about my daughter. My daughter was in art class and they were working on a stained glass project and my daughter was cutting some glass and it broke and she got some in here eye. Yes she did have safety glasses on (adult glasses) that didn't fit her face very well. I took her to the doctor and they pulled 3 pieces of glass out of her eye. The school told me it was my ins. that has to pay for it because I didn't purchase the ins. they offered. I told them that if they are working with glass that they should have safety goggles on not glasses, I even have a statement from the doctor stating the same thing.
So I feel for you FYI. But at least we do have ins. Good luck and I wish you the best out of this. I still think that the school is responsible for your sons bills. I mean how hard is it to grab a mop and wipe it up to keep someone from slipping. I am sure that if a teacher would have fell it would be a different story :x

It is a shame that so many people in this country can't afford insurance. I left my last job because of their high priced coverage. Meanwhile you would think that the Education Associations would realize that and provide coverage. Or at least have affordable coverage and let people know it exists.
