If you deliberately gave the storefront a check with the intent to defraud you could face jail time. You did not do that. You just could not cover it or stopped payment. I just defaulted with a storefront PDL last month and I called them and they told me that I can send them partial payments whenever I can just as long as i don't ignore the debt they won't take legal action. Give them a call and they will work with you.

Samuel Bishop called me telling he had a court order to collect or prosecute me for fraud on a payday loan and that I could lose my job. he told me that he was from the crime prevention unit. No one ever has called or sent me any correspondence to where the payday loan came from or what company or address of the company. Mr. Bishop refused to give any names or addresses of my lender, I thought I had paid off all my bills in that area. He was willing to work with me, but I did not have have of the bill money and could give any money. I explained to Mr. Bishop that I could not do anything until September 10, 2008 and every month I would pay something until it was paid in full. First he would not agree, but when my daughter called him he was willing to accept $200 the next morning, My daughter could not borrow the money and when Mr. Bishop was asked to give an address where the money could be sent he refused to give it me. I am not trying to get out of paying any dept, but I do not want to go jail either. He also called my place of employment several times threatening me and my Blood Pressure shot up so high I had to be rushed to the hospital.

The week after I wrote the "postdated check" for repayment, my bank acct was scammed by someone who obtained personal info from payday loan. I contacted the attorney general, the FBI, the district atty. The PD loan company was forced by the atty general to offer a repayment plan. In some states, the PD loan companies are forced to offer 150 days to repay with no interest. It is NOT correct that the storefronts will work with you. This has not been my experience, I contacted the store front personally, in writing, and they refused payment plan. I contacted the CSO (the bank or insurance company on your contract). They refused. I had to resort to federal intervention before the PD loan company would refrain from practicing predatory, usery business dealings. I have heard that pay day loan companies will become illegal when the next legislature is closed in March.
They are most time out of state banks who are lurking in out of state store fronts and refuse to abide by the laws. They also sell your information to foreign internet criminals who will

card number if it is linked to your bank acct. This is what happened to me. I closed that bank acct and debit card. I now use a "walmart preloaded" debit card. No one will get
my debit card that is attached to my bank acct, my direct deposits. PD loans also engage in illegal tactics such as
harrassment, threats. Hopefully they will be forced to close up.

i had a payday loan with a company and paid them then a few months to a year later i needed another one and had so much going on like loosing my job my place of residence and even my kids that i had forgotten about it. i had no intention of skipping out on them but dont remember getting any info or reminders about it either. if i did get something about it i am not sure what happened. now i am being told that i will have to appear in court. can i go to jail for this it happened in the state of texas.

Can someone help me? I have three storefront loans (cso) and lender is NCP Finance limited partnership (ohio). I also have one internet loan (cso) with NCP finance limited partnership. I am the state of texas. Can NCP fund all these loans? Do they have to be licensed?

i have two storefront payday loans in texas both hitting me on the same payday,breaking my acount. cannot get them paid off, work cut our hours back with a looming layoff nearby! any suggestions? don't really want to call in my unemployment from jail!

They will Not send you to jail. Go in person and explain to the manager that work cut your hours and ask them to set up an arrangement.

What state are you in and what are the names of the store front lenders? If you haven't defaulted yet and these lenders are members of the CFSA you may be eligible for an EPP (extended payment plan), but you have to ask for it, they won't tell you.

Iam caught in a store front payday loan, i got a payday loan for my brother and he paid the first finance charge on the loan but was not able to make any more payments, so i help make about two more payments on the finance charge which was 138.00 dollars each time and i had to make that with cash and then leave a sign check for the next date. So my question is can you go to jail if you are not able to pay the loan back. And since then he has lost his job. And i am on a fix income and i cannot pay the loan back because i only get x among of money from SSID. So can you tell me what i need to do, please, please i need some reply. I am not in the best of health to go to jail.

You can't go to jail for owing a debt. Depending on the store front, tell your brother to ask them if they offer an extended payment plan, some stores do but it depends on your state and the store.

I have defalted on two payday loans in Texas due to getting layed off. The loans were over a year ago. I just received a letter notice of intent to pursue civil collection efforts. What does this mean and will I go to jail or have to go to court for this. It was out of my control I almost lost everything.
Were these store front loans? Did you use a check as collateral?

A civil suit only means they might pursue taking you to court to obtain a judgment to collect money due, you will also be required to pay court costs, so it would be in your best interest to contact the lenders and make a settlement offer.
