I live in TX and have a delinquent payday loan with AIP. I'm in a rut because I have no way to pay them now that my checking account is overdrawn and they only accept ACH payments. They offered to allow me to send them a money order for the full amount of $389 but of course, I don't have that. What should I do? They left me a mesage a few days ago saying that if I don't pay them with this paycheck, they will take legal action.

How do I know if a payday loan company is legal or not? And what action should I pursue since they will not stop calling me? I've already had my bank block any debits from my checking account from them, but I am not sure what else to do to get them to leave me alone and not call me at work (I work at a police department and they really frown upon personal calls)?

Blocking debits from them will do NO good. They will use mant different names and amounts to get your money. They will even put thru paper checks. You must CLOSE your account and open a new one at an unrelated bank. They will take and debit many ways and they will not stop. Blocking them will do no good.

So after I close my checking account, how do I get AIP to stop calling? Do I speak to someone higher up in the company about their being illegal or something?

Also, how can I find out if a payday loan company is illegal (for example, how did you know that AIP was not legit)?

Thank you sooo much for your help! I've been having trouble sleeping over this and other loans (AIP is the only one not willing to work with me, though).

Where do I look to find this info, too? I know I sound kinda silly, but I am so lost about this payday loan business. I'm on the TX Attorney General website right now and I don't know how to find these licensed lenders.

There is another company that I have made payment arrangements with (through my checking account that is now overdrawn), CashToday Ltd that also only takes payments from checking/savings accounts. Do you know of any way for me to work something out so that I can pay them off with a debit card?

In Texas there are 2 ways a payday lender can be legal. They can be licensed as a payday lender, or lending as a CSO. You can check for CSO registrations on the Sec of State website.

AIP is a company that if you file with the BBB they usually cave. Nothing else works, but for some strange reason the BBB hits them. Also, they do most of their stuff over the phone. Call them up, and try to speak with a supervisor.

Cash Today LTD is illegal.

Got it. Now that I know that both of these companies are illegal, what steps should I take? I'm going to Wells Fargo tomorrow to get my account closed (or should I wait until I finish paying off the $2000+ I owe in NSF/overdraft fees?) and I filed a complaint with the BBB a few days ago (haven't heard anything back from them yet). When I call to talk to the AIP supervisor, what should I say? Should I try to make some other payment arrangement with them(even though I've been paying them $180 a month in processing fees for the last 4 months)?

And do you know what I should do about Cash Today? Would speaking to a supervisor do me any good?

Dont let the bank talk you into stopping payment . It will not work. These companies go in under a million different names and dollar amount. There is no way to stop payment and be safe. If you cant close it , which I am almost certain that you can not because of the nsf, you need a hard debit block put on the account.

So is there a way for me to not have to keep paying either AIP or Cash Today, as both companies are illegal? I recognize that I owe both of them money, but I am in no position to pay either of them (since I have no usable checking account right now and both require one). AIP even suggested that I find a friend and use their checking account (which I have no intention of doing)! When I speak to a supervisor at AIP, what should I tell them to get this situation under control?
