concerning garnished wages?

First Merry Christmas and happy holidays,
My son and daughter in law have moved in and they both have bill collectors calling for them.My daughter in law had a law office out of atlanta call for her regarding sears account.She told them what she could afford a month and they told her they would let sears know.Three weeks went by and she ended up calling them back and the law office was very cold to her and said they are going to garnish her pay and have started the paper work.Here is the problem she has quit her job because she found a better job and has already received her last pay check and the law office does not know where she works so law office and sears got nothing so where does she go from here.She does want to work this out she is not running away but she only afford a certain amount every month so what should she do call the law office again or call sears any suggestions.


I would call Sears and see if they still have the debt, or if they have sold it to a junk debt buyer.

Sears often uses LVNV and they don't play fair.

If Sears still has it, have her talk with them about their hardship programs, they will drop or lower the interest until she gets it caught up or paid off.

If it is sold, have her send a debt validation letter to the company calling her-many attorneys are also debt collectors-she needs to make sure who has the detb and who is legally bound to be able to collect. Hopefully, it is still with Sears and she can start payments with them-it's much easier than a collection agency.

Also, they have to take her to court before they can garnish wages, and get a court order-they can't do it on their own..Good Luck..KAren
