OSI is asking for a debt payment that I do not owe
Date: Tue, 09/27/2005 - 17:23
I have been recently contacted by OSI(9-22-05)-they told me they would not accept payments-and that if I did not pay the amount due either in full or a settlement amount then they are going to pursue further actions, I have been reading up on the Fair debt collection act and I understand that after the first initial contact they are required to send a letter of validation to me, they have not. They called me yesterday at work-I told them not to contact me at work and they asked when I would be able to contact them-I did tell them that I may be able to contact them today(9-27-05)-however after doing some more research I feel it may be in my best interest to wait until I receive the letter?
I have all three of my CR reports and not one of them has this credit card listed on it? I also noticed that OSI did a credit check on me, it shows them on my CR as a credit inquiry are they allowed to do that?
Any help would be greatly appreaciated.
Thankyou!
Tray, You can't stop any agency that is checking your credit
Tray,
You can't stop any agency that is checking your credit but it should be done only for legitimate reasons. Moreover, they need to take permission from you before they do so.
I think that you informed them over the phone that you don't want to be contacted further. To make it more legal, send a debt validation letter to prove the debt and also to stop all the collection efforts unless the debt is proven.
If they are unable to validate the debt as you requested, you are legally not required to pay the money. You can force them to remove the debt from your credit file if they ever report it to the bureaus.
Make sure that you send the letter through certified mail with return receipt requested. In this way, you will be able to keep a record of your communication made. After they receive your letter, any such activity that you didn't prefer will be a violation of the fdcpa law.
How do I get collection agency address?
Thank you Ben,
I have yet to receive a letter from them so I am not sure what their actual address is, They left a message on my machine yesterday (9-27-05) and then called me at work again today (9-28) even after I told them that I did not want them to contact me at work-The woman I spoke with told me that I did not tell her directly-however I told the woman on Monday, that I was not to be contacted by anyone at my work place. She told me that I if I did not call her back on Thursday then she would consider this a refusal to pay.....When I got home this evening there was a message on my machine from the same woman that contacted me at my work place.
Do you think I should call her on thursday(9-29) and ask her for their address so I can send them a letter of validation? and request that they stop contacting me until I receive a letter back?
I am so confused, the more I read the Fair Debt Collection Act the more I feel they are violating my rights.
Any advice will be greatly appreaciated
Tray, calling them will not prove to be helpful in any case. OSI
Tray, calling them will not prove to be helpful in any case. OSI is not working within the legal lines and they might not even have the details of your accounts. So, hoping that they can intimidate you, they will try to put you in tremendous pressure so that you pay them out of fear.
As per the fdcpa law, put your cease and desist letter in writing and send at the following addresses. You might not know the branch from where they are calling you. If it is in your state, you can pick up the right address:
Once they receive your letter, they are required to stop all the collection efforts as per the FDCPA law. Violating such laws will enforce you to take legal actions against them.
