They can't charge you with anything. They violated the Fair Debt Collection Practices Act by doing so. Debts are civil matters, not criminal. File a complaint with the CA state attorney generals office, the Federal Trade Commission, and the CA state Bar Association.

I'd be willing to bet there isn't a single "attorney" employed at National Attorney Collection Services. The name of the company alone should be a violation of the fdcpa. Some CA's seem exceptionally creative when it comes to thinking up names that try to appear misleading or intimidating.
I could be wrong, though, there may be an actual attorney employed there. I would be sure to ask their name and where he/she is licensed to practice law.

I have been contact by this place with plenty of attitude. I was threaten with legal action from this place. the person that contact me claim he was a paralegal and represented an attorney. When I asked if they could fax me a letter on their company letterhead that is when the problems started. This place is shady. They do not follow the credit and collections act. Do not deal with these guys they are bad news.

We have just started receiving calls from this agency, when we asked to have them put the settlement in writing they refused.?? We were willing to pay as long as we had something in writing, I spoke to three people before being told not to cal them anymore until I had the money to pay them and that they would not put anything in writing.?? To top it all off they wanted a credit card number, just a little suspicious of there practices.?? I am in the process of contacting the Fair Credit Bureau regarding this.?? If anyone knows any information please let me know.

You don't know how happy I've been to find this forum. My mother just passed a few weeks ago and I've just been through so much lately. Worst comes to worst, I get a call from a creditor, which sounds like a a law office or something. I haven't contacted them back because I'm sort of afraid to. I have 3 kids to feed on a single income. I don't know what account they're calling to collect on, but I'm assuming it's old because I haven't had a credit card since I was 19 or 20 years old. I think they've been harassing my mother in law also, but she doesn't speak english. I don't have a detail of my credit report, just the free ones that I've ran a couple of months ago. I'm in California. Does anyone know the SOL for California? What should I do?

So I ignore their calls, I will pay when I get a bill from them. Every other collection agency sends out bills, so why can't they? I told them to take me to court, they still have not done a damn thing and I am pretty sure they won't!!! Just ignore the calls, they always call me and the number shows withheld!!!

Threating an officer would be at my door on monday to take me to jail and that they would call my family and friends as well as contact my employer and have me fired. I did file bankruptcy and there was a payday loan in there, they told me that Charpter 7 doesn't cover this. When I spoke to my attorney he said they were trying to scam me .....

I just got a call from this place, I had a $500 payday loan they said they were taking me to court and that I had to pay 2600 plus my legal fees. He said the only way to avoid it is if I gave him $500 today otherwise my case is going to court. I told him I didn't have it so he asked me to borrow it from someone! LOL He gave me his number and told me to call him when I get the money.

I think these guys are full of it, and there practices are against the fair debt collection act...if they call again get all the information you can get from them, and let them know you will be reporting them,... bet they wont even give you an address... besides, you cant be sued for not paying, the payday company acknowledges that you may or may not have funds behind that check when you give it to them, they are holding that check as a promissary note that you will pay, so it cant be considered check fraud... have no worries

My wife's son received a message from these people asking for my wife on a pending urgent matter.....they haven't even tried to contact my wife first ! I'm glad I'm doing a little research on this Mickey Mouse/Fraud operation...

these people just called me a very lovely lady named Leslie Herring, saying that I owe 500 dollars tommorow or I would be brought to court the very next day and have to pay 3 times the amount, I started asking for proof of my contract and she started to be rude until I agreed that I would pay the full ammount tommorow, thank god I found this forum.

Are you always easily intimidated?
What they're doing is illegal. They can't bring you to court tomorrow. That's an involved process, and takes weeks or months. And $500? Most places won't move to legal action for that little until much later in the game. They can't demand 3x the amount, either.
If you're absolutely certain that this is actually yours, and that everything they're saying is on the level, then go ahead and pay them if you want to. I think you're being had, though.
Otherwise, please give us some more information. What type of account is this in regards to, what state do you live in, and when was the last time you made a charge or payment on the account?
In your position, I'd hit these folks with a demand for proper validation so fast it'd make their eyes water. There are laws thet govern collections, and certain procedures that must be followed. Just calling you and saying 'Gimme!' doesn't cut it.

I received this exact same message yesterday...at WORK, as well. I do believe he called my cell phone also, but blocked the number and did not leave a message. Was his call back number 877 202 5736? I mean, I do have an outstanding payday loan (a few as a matter of fact), but at the time of taking them out, I was in a really bad situation and needed the money. I am in the process of paying them all back, but can't pay them all at once. Anyway, I haven't returned his call yet either. Like you, I wanted to 'google' the company first, and found this site. I think this 'courtesy call' is somewhat of a 'trap' to get me to call so they can start to harrassing me, so I'm very hesitant to return the call as well.

These people called me too - same phone number - I called back - the guy was polite but pushy - told me an $800 payday loan would end up costing me over $4000 by the time they took me to court - gave me 24 hours to pay twice what I borrowed. I had been working with the payday company but when I asked for something in writing they stopped communicating and got these guys after me. I faxed him a copy of the letter I wrote them offering to pay certain payments per month, and I never heard back from him. I am worried they will cause me trouble at work though.
I had a similar incident with another company, but when I called back and asked to speak to someone else, the second person was nice as could be and helped me out and now it's all straight.

I just received a restricted call from National Attorney's regarding a pending legal matter and to give them a call at 877-202-5736 x253. I ofcourse googled before I did anything and found this wealth of info (thank you). I wasn't going to call the # back, but now I wonder if it would be worth the trouble of calling and letting them know I am forwarding the name and phone # to my attorney and they can deal w/him. Any suggestions?

I used to work at a collection agency and we had Attorney letterhead that was FAKE we would send to people after our 5th phone call attempt. Or after the 3rd default on a payment arrangement. It was just really crase and the only successful guys were the ones that were lucky enough to get people who really wanted to pay the bill they owed...otherwise after so many attempts the account was closed and written off and packaged to sell to another collection agency!
These guys left me a message today threatening court action and so forth and so on and I will NOT give them the satisfaction of even answering the phone!!

Ok, so these people just left my mom a message telling her I needed to call them to stop legal action against me. So I called the guy back, Louis Vorbeck, (ie:jerk), I only verified my name. He said that he couldn't give me any information about what company was had me at collections until I verified the last four of my ssn. Which I did not. But then proceeded to tell me that he would be faxing info to my employer to subpoena me to court. He could "threaten" me with that, but not tell me who the originator of my debt was with? And yes, I do have an outstanding payday loan out there, a couple of them actually. But I was in a bad situation. My son and I were in the process of leaving a very abusive relationship and I had to get out. I needed the money to leave town. Anyway, right now I am in the process of paying some back, but I can't do all at once. First, is it illegal for him to have told my mom about "legal action" that is to be taken against me?....and second, if they do take me to court, should I file an answer back? I have a feeling the case is from a loan company who sent money back to me that I attempted to pay them. I wrote a letter to all the loan companies I had debts with, explaining my situation. I also include, albeit very small, "good faith" payment. They returned it to with a note attached stating they couldn't accept anything that small. I tried to send it to them again, to show an attempt to pay, and got it returned again.

I rcvd my first phone call on yesterday from some guy at 877 202 5736 ext 270 who told me basically the very same thing im reading on this forum...if I do not pay them back my settlement amount of 1500 on a 700 loan that I will be sued for check fraud for an amount of 4500 which is absolutely insane to me. If I had that kind of money to throw around I would not have needed the loan in the first place. He told me to find some people to borrow the money from and call him back today. When I did to tell him that I had no luck, he told me he can break my payments up into 3 payments...500 bucks a pay period. I didnt want to laugh in his face but it almost happened. At this point I explained that I can do maybe 100 a payperiod which is a serious stretch but an attempt to take care of the debt. He would not accept it and insisted if I cant do 500 a pay period then Im going to court. I told him I will make some calls and find out what my options are and will call him back before they close 5pm pacific....8pm my time. Then I found this forum. Since reading this forum, I have called the FTC @ 877 382 4357 to file a complaint against them. After giving her my information the rep explained to me that I will rcve a confirmation # in my email and it will explain to me what they can and cant do. When asked if action will be taken against them for this maddness, she said only if they receive enough complaints about them will an investigation be opened against them. At that time a class action law suit will be drawn up on behalf of the plaintiffs (which means us). So Im going to get this ball rolling. I dont have a problem paying what I owe, but Im working too hard to make ends meet in this recession to allow some company to rape my income.

Also, I am in TX and the number they called from was a TN number, which when i redialed it, said that it was no longer in service! Amusing to say the least! The only unfortunate part is that I am sure there are people out there that fall for these unfair tactics.

I called back and it was for $100 that I was willing to clear I ask him for something in writing and that when the problem started. I said you must have something in front of you if you know I owe you. They have been calling me for weeks on my phone and at least four times a day at work even when I am not there. They have even spoken with my manager. After reading all these posts I asked them to fax or send me proof of my debt and they would not provide it and they also did not want to provide the attorneys license # or their state bar #. After asking all of this the guy replied that they are just the creditor that the company sends their debts to when they can not collect and that he's not trying to collect. He will just proceed with court proceedings. When I asked him what company he received by debt from he couln't tell me. He told me if I didn't pay now it would triple when it gets to court. Something doesn't sound right with this company. I work at a payday company and they are always sending out emails letting us know to be careful because of so called company's doing things like this and it fits all the descriptions we receive.

I have been getting calls from a so called National Attorneys Office. SO I called them back to find out what it was about and it was for a small payday loan. THe start out by saying to write the case# down then they pretend to be an attorney by saying please hold while I go get your file while you can clearly hear many call center reps in the back. I admit I do owe but I need to be harassed for small payday loan that was under $600. I have enough stress trying to raise a 13 yr old and 6 month old while working a low paying job and trying to finish school. I live in MO and I believe there is a law against this. I suggest if you have a debt, go to the place to pay it off, NOT through these dummies.

i too contacted national attorneys today asking for a bill. spoke with a David Michaels, who states they do not send out bills, they just collect. i advised them of their bad status with better business bureau and all the negative comments about them on the internet and he gave no explanation for them. i then stood firm on the request that i receive a bill or they would not receive any payment from me. he hung up.

Fact is, they could care less about bad ratings at the BBB, or negative comments left online. Why? Because those things have no teeth. If you want to complain about a CA, you need to direct it to the FTC and your state Attorney General's office.

When you get that letter, immediately hit them with a strongly-worded demand for validation. They'll probably fold like a cheap suit.

I was also hesitant to return their call but after talking with my lawyer...he did advise that it was better to pay back the original loan...this company may come off a little firm and create some fear...but in actuality, not paying back payday loans can get very expensive....its always best to pay back your debts before things get too uncontrollable

The Banking numbers they gave me were for Bank of America and the peoples names were not mine they lived in Houston I'm in San Antonio. Also they refused to produce paperwork for me. I have 6 bank acounts all of which are through credit unions and military ones at that. I have direct deposits I NEVER CASH CHECKS THROUGH ACE OR CASH ADVANCE yet alone do online loans.... Fishy!!! so now after getting a call from the first girl I am getting a call from a so called attorneys office... I've made a police report but dont know where else to go from here. I'm not paying them crap. I will call this lawyer tomorrow to see what he says but I will only ask for his name and bar# if he doesn't produce legitamate information I will ignore the phone calls. It's not on my credit report and I put a fraud watch on all three bureuas (sp). One last thing they aren't even contacting me through my phone but my parents house phone. I was looking for a job 4 months ago and applied on craigslist everyday. I used my parents house line on apps.... These guys are just Scammers.
