Hi,
Ijust got a call from a Mrs Bog at A.S. Assoc from Nat'l Money store. I took out a $450.00 PDL and wanted to pay it back, however, right after that My mom died and I had to use that money for going out of town. I did not have a paycheck coming in as I was gone (no benefits) and my account was neg. i spoke to my bank, they closed the account and I am making payment to them each week. By "Attorney's Firm" A.S. Assoc called and they were very rude, threatening prosecution for fraud, jail time etc if I do not make payment. i explained my situation and that I don't have any money right now with 2 kids. I planned on paying them back, but after that phone call, they got me so ticked, I am thinking about not paying them at all! Can they put me in jail, what is the worst they can do? Any help and information is greatly appreciated.


No they can't put you in jail and are breaking the law themselves for saying they can. Send them a cease and desist letter and a debt validation letter. Also file a complaint with the FTC for violation of the fdcpa. The worst they can do is take you to court to get a judgement which is not likely at this stage of the game. The judgement merely proves that you owe the money. There are no debtors prisons in this country!

I did not got to a store, filled out some stuff on line and faxed some information and the money was in my account the next day.

I am in Michigan, so the worse they can do is harass me, and probably report a bad debt on my credit bureau, she threatened fraud, and that is punishable by law with jail time, can she do that?

This A.S. Assoc is in TX, I have no idea where the PDL place is located. What if the summon's me, do I have to go all the way to TX?

They have to summons you where you live. They are just trying scare tactics right now. You are dealing with a third party collector who is required to validate the debt if they receive a written request and to cease calling you if they receive a written request. This should be sent by registered mail.

I haven't paid them back anything yet, I was gone for 3 weeks and that is a long time with out a check.

I am interested to see if they are legal in MI. I was told to be careful that he thought these places were scammers. This site is very helpful and the response time is great.

AS&Associates threatened me last year. Greg Patton.....Told me the same thing...I was going to jail even asked me if I had ever been on probation. I asked to validate the debt. He faxed over a paper saying I owed 570.00 on a 300.00 loan that I had paid back several roll-overs which are not allowed in the state of IN. They will harass you into paying....File Complaints with the BBB and your State Attorney General's office.

After I told "greg patton" that what he faxed me was not an accurate amount- I never heard back from them.

these people if you can call them that are evil to the core!!! they threaten people , belittle them and make you feel like scum.
I talked to a miss lee. she actually said at one point of our conversation that i didnt seem to care I was going to jail and was I in jail before....the nerve. she was trying to collect 660.00 for a 200.00 loan. I sent them the 200.00 cause I figured they did give me the 200. when I needed it but theyre not getting a penny more. Vultures. :evil: Im so mad they use these tactics to people. I mean collect a debt or try to but dont threaten people with jail....
