Hello, I happened to take out a cash advance with a PDL company. After renewing the loan for about 2 times. When I was due for my 3rd renewal I went thru some financial difficulties which caused me to be unable to make a payment on my due date of renewal for payment in the loan. The cash advance made 3 drafts which all added together totaled the principal balance plus the renewal fees. With those 3 payments being drafter without my account having any money they overdraw me 3 times on that date. They did the same thing 2 days after, and did it 4 times on the same month. The thing is I only get paid twice a month so they overdraw my account 4 times. Because of that problem, I called them and they refused to pay for the money they cause me to lose with my bank. So then I closed the bank account and never heard from them for over 5 months.

Today a lady called Bonnie called prrivate to brother's cellphone from a company called PDM (Phoenix debt management). She asked for me and he said I was working. She then told him to take a message and told him this was concerning a payday loan in the amount of $500 and gave a ph#888-622-0222 for me to call back. I was very stress because I did not want him to find out:
-I was just wondering, isn't it illegal for debt collectors to give your personal busines matters to other people other than the actual person responsible?
-If the answer to the prev question is yes, what can I do to sue this company and how much can I get from them????

Thanks for your time and help....

It is clearly a violation:
What Restrictions Are Imposed On collection agencies By The fdcpa?

The FDCPA restricts debt collectors from engaging in conduct including the following:

*

Contacting a third party who does not owe the debt, such as a relative, neighbor, or your employer. Co-signers to the debt, however, may be contacted by the debt collector;
