It doesn't matter what state you live in. All debts public and private (aside from IRS) are civil matters, not criminal. It is also against certain federal laws for them to claim you have committed a crime, will be arrested, or that they are affiliated with any government agency. You can file civil suit against them for this. I would suggest reporting this activity (and the email) to your state Attorney General's office as well as the California state Attorney General's office, and the Federal Trade Commission. You may also consider seeking legal council to file suit.

The debt itself is a civil matter, but there does exist the possibility of bad check charges, which are considered criminal. They aren't suing for the debt, they are going after the funds the check would've paid.
I don't know if an echeck would count, but it is something that should be looked into. I know that if it had been a paper check the possibility does exist that charges could be filed.

I had something similar to this. If it was a check, then there is the possibility. I honestly did not intentionally write a bad check, the date the check was written had plenty of money in the account..then the account got hit with a bunch of bogus charges and such and in the fallout..a couple checks bounced. They still sent it to the district attorney and they told me I could pay it or get charged with bad check and see a judge over it. I did not want to go through all that massive hassle and possibly get something on my record so I just paid it???????.I was going to anyhow, but at the time I was in a financial mess and simply couldn????????t.
However???????.echecks, ach, anything that is done through phone or internet is considered electronic funds transfers and stuff under headings like that???????look at your state????????s laws pertaining to electronic transactions. Also, point out that you simply canceled and them attempting to take payment was illegal on their part, also inform them that they failed to provide the agreed upon services and so are entitled to no money at all. Tell them making bogus threats of criminal action IS a definite offense and they can and will be sued for it.

As best I can tell it is some low-life in his mom's basements scamming people. He is a joke.
He would be hard-pressed to go after you for a ACH for fraudulent services.
