Judgments cannot be filed unless the court issues some legal papers in your name. You can check whether a judgment has been filed in your name from the clerk or the reporter’s office in your state.
You can also confirm it in the latest credit report from all the three bureaus. If your creditors win a judgment against you, chances of garnishing your wages is mostly possible. Disability and credit card debt
Do you know if they can garnish SSI disability checks ? I was separated from my wife when I had this Credit Card so her name is not associated with my debt, do you know if they can go after her wages anyway, thanks AKD.

Benefits like SSI disability checks should not be included in the garnishment procedure. Deposit the benefit checks in a separate account away from the other money.
Since the lender with a judgment against you will check your bank accounts, credit unions and other savings and loan accounts, benefits should not be mixed with the other money. Otherwise, it will be tough to prove the money from the benefits in your checking or savings account.
You can use a savings or a loan account for depositing your benefits because there is a law that the first $500 in your account cannot be garnished.

If a garnishment takes place in your name, your wages will be only garnished, not your wife's.
