I was recently contacted by a Michelle Smith from A.S. and Assoc. in regard to my defaulted account with Direct cash Express. She told me that a complaint had been filed against me over this debt. What exactly does this mean and does it sound legitimate? :?


Sounds like Michelle is trying to intimidate you into believing you have been charged with a crime. The original creditor (not a collection agency) can file a civil lawsuit against you if they so choose, but only to obtain judgement for payment on your debt with them. This may be what Michelle is trying to say, however, she best be careful, because she can not threaten you that a suit has been file or will be filed if the original creditor has not or does not actually into to do so.

If you speak to her again, ask her to be more specific regarding the so called "complaint". Like, who filed it, where did they file it, what is the nature of the complaint and why havent you been served by the proper authority? She wont answer any of these questions, she was just trying to scare you into make an immediate payment.

The representatives from A.S. and Associates are trying to recover a past debt from you by putting it in legal shape. If a complaint has been filed against you, some legal papers should be served to you.

You really want to know if the said debt exists in your name and the company is recovering it legally. There is an act of debt validation as per the Fair Debt Collection Practices Act which will prove this debt if it sounds legal.

Ask them to give you the complete details of the past debt. They are required to present the total amount of money owed with proper calculation of interests on it.

They also need to produce a copy of the agreement letter stating that the creditors have legally passed the debt to the collection agency and they are working on it.

In a copy of the agreement letter, it will be clearly shown that you entered into an agreement with your creditor in the past and you are required to pay the debt.

All these necessary information will cover the debt validation method based on which you will be making the payment arrangements with the collection agency.

You can refuse to pay the debt if the provided information is disputed and further verification is required on it.

You should send all the letters through certified mail with return receipt requested. This will help you to track your correspondence and your efforts made to pay it.
