Do you know what the process of suing is. I have received a regular letter of intent to sue if I don't make payment arrangements in 5 days of the date of the letter but of course the 5 days was over with by the time I got the letter so what is their next step?


When you sue someone, you file with the proper court and pay the filing fee. Notice is then served on the defendant, who has the option of answering. If there is no answer filed, a default judgement is entered against the defendant.

If an answer is filed in time, then the matter will usually go to trial or mediation, depending on your court system.

Do they not have to send me a certified letter of intent to sue?

I don't think the law requires it. But some creditors will tell you they are going to sue you if you don't pay, to try to get you to pay up. But the law requires them to go through with it. So if they have said if you don't pay they will sue, they could get into trouble if they don't go through with it.

At this point I have a letter, not certified, I have been asked to provide a copy of the contract to my debt negotiator and have asked for this through email to be sent to me online and they tell me to log on to the website to get it but when I do I cannot find anything so I was told to send them a certified letter requesting they send me the contract through the mail.

I have two issue where I need to file a letter of intent to sue.

1. vs my ex-gf who is slanderig me, and with holding personal legal documents relative to a case vs my ex-employer.

2. Sprint has shafted me monthly on trumped up fees for services on my phone that I do not use, and had deactivated from day one. I demanded the contract be cancelled, and they refused; continued to charge me for the service, even though I mailed them back the phone in November, and over 35 times demanded the conteract be cancelled. I want to sue them in small claims court for the harassment I have had to deal with from Sprint, the fees they over charged me with; and basically sue them for refusing to cancel my contract. I realize the suit might end up being dropped. But, if it costs Sprint $600 an hour to have a chimp in a chum suit come in to fight it out in small claims court; the $300-$400 they are trying to scam me out of will be wasted by me fighting them out in court. Hopefully this will press them into backing off of me and finding someone else to rob.

If you know of a site where I can read such a letter, please enlighten me.
