I am also looking for a question answered. I have already taken it upon my self and sent out a Validation letter and asked for them to verify if this is my account of letter I revived. They sent me back statements from 2006 till now and nothing else I asked for. How do I even know This is mine. Do I send another letter asking about the other things to show that this is my debt or what, I have also asked them to send verification as to whether their company is real or not(and I never received anything on that either) because in the past I have received a debt letter from Merchants' Credit Guide(note the ' above Merchants')stating I owed Citibank over $5000.00 and in fact have already paid Citibank. They are a rip off If any one receives a letter and wants to know more about them I have added the link. chipford.com/ripoff/merchants.htm.


I am having the same problem with a CA. I have 2 debts left to settle. The original creditor wrote off the debt and these accounts have been passed from one junk debt buyer to another. The last CA contacted me by phone but left no message and sent no paperwork, so I looked up their info and sent them a validation letter. They replied with statements from 2005. I have no idea what they say I supposedly owe now and no idea if they are collecting on behalf of the original creditor or if they purchased the debts. I requested all of that info in my 1st letter. After I received the statements, I sent them a 2nd letter telling them that I appreciated a response but they did not send what I asked for. I am currently waiting for a response from them. They have about 1 month left to collect, as the SOL will have expired on both accounts next month. Good luck with your CA.

pet sitter va, With only a month to go till they are out of SOL I don't think you should be DVing them,let the SOL pass.

suzanne, what is the "date of last activity" (DOLA) on this account? Are they reporting the account to the credit reporting agencies (CRA's)?

The problem with DV's is there is nothing that spells out what is a proper validation, theres court decisions on what is not a proper validation.

I can't get into a long "validation" post right now, I'll try to post more later tonight.

You need to tell them that this is what you want, in your letter....not just asking them to prove the account is yours:


??????? The details of the account
??????? All the calculation should be shown of the amount that is owed.
??????? Any copies of the papers to be furnished that shows the payment agreement.
??????? Provide a verification or copy of any judgment if applicable
??????? The original creditor needs to be identified.
??????? The Statute of Limitation needs to be proven for the collection of the debt.
??????? The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent
??????? Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.
??????? Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.
??????? A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

I got a letter from a atorney's office collcting for an old account. I sent them a DV letter and all they sent back were two statements. Some charges need more clarification the statement was hard to read.
Just sending me the statements, does that complete the DV process? I did send them another letter again requestion other information, like suggested on this site, do they have to send me what I ask for in the letter?

As was mentioned it is iffy. In a court setting, they would need more documentation on the debt, you could mention that in your letter. Simply spell out what you want to see. Inform them that until such a time as they validate the account fully, they will stop all collection attempts or they will be in violation.

lonegunnman, the last statement date was 11/5/2005. Yes it is on my CR. CR says I opened the account in October of 2005. Ok if the last statement date was 11/2005 how could i have opened the account 11/2005 and have statements that he sent me back from 5/2005 if I opened it after the statement date. I guess Ineed to send anther letter asking him this question.

I dispute your claims a 2nd time in their entirety and request validation pursuant according to the fdcpa.

Be advised that I am not requesting a "verification" that you have my mailing address, I am requesting a validation, that is, competent evidence. Also, please provide the original creditor's name, address, and date of last activity. Communicate with me only via US Mail.

If your offices fail to respond to this validation request within 30 days (as with the first letter dated October 12, 2007) from the date of this letter, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately. I have maintained all records and copies of any correspondence.

I am formally disputing the validity of this alleged debt. Please send me validation of this debt in the form of the original written contract, a complete payment history, an itemization of the alleged charges as well as items and a copy of the contractual agreement between yourself and the original creditor that indicates you have the legal right to collect an alleged debt. I am requesting validation under the protections afforded me by the FDCPA, of which I am sure you are familiar. Please comply with my request or issue in writing a statement of withdrawal within thirty days from your receipt of this letter

The statements you sent were all incorrect. According to my Credit Report It says I opened this account, which I did not, in October 2005. The statements you sent me were dated 5/10/2005, 6/10/2005, 7/10/2005, 8/10/2005. 9/10/2005, 10/10/2005, 11/10/2005. If I supposedly opened this account in October 2005 according to my Credit Report from Experian how can you send me statements before it was opened?

Please be informed, I will pursue all of my legal rights against your firm should you violate any of the FDCPA guidelines. I have attached the original letter as well as a copy of your envelope with the date on it and the signature of the person who signed for it back in October of last year.

just found out it is when you opened it. here is the information provided me on the net by Landmark Consumer credit counseling Services:
you have an account with a creditor that reports to a credit bureau, your credit report will reflect a payment and account history. The information that a credit bureau reports regarding a consumer's history on a credit account is referred to as a "trade line." On your credit report, there should be a "trade line" for every creditor that reports account information to the credit bureau that is providing the report. Following is a summary of the information that is normally included in a "trade line" on a consumers credit report:

Name of the creditor
Account number (usually incomplete of coded for security purposes)
Type of account (installment loan or revolving)
Balance owed
Summarized payment history
Date the account was opened
Credit limit
Co-signers on the account
Date information was last reported to the bureau

I am sending the above letter tomorrow to have this taken care of. thanks for all the help.
