They have also called me and came to an agreed amount(half of the balance and the account stated as Paid in Full)for an old Target account. However, they keep telling me they will not send a letter agreeing that the account will be paid in full until it is paid in full. How can I get them to understand that I do not want them to send me something saying it is paid in full before I pay them, I just want a letter stating they agree to the account being settled as Paid in Full. I keep saying just to send me something in writing before I send them a dime.
I do have to say I have not sent a DV on this, but I do know the account is mine. Should I send a DV before sending them any money?

Spell it out for them if you have to, might go something like this:

"At this time I am only requesting written documentation that we have agreed to the proposal that once I have paid x amount that I will receive documentation after you have received payment stating that the debt in question is in fact paid in full."

Not too hard to understand

wow...just wow....

I cannot imagine why anyone would have such a hard time getting what you are asking for. Especially when you are dealing with a business on a business matter--what business today shouldnt cover their butt like that?

Debt Collector....Dunce Cap....same initials....gee, I wonder why....

iwish--I would check with your state's secretary of state office. Not sure of the laws in SC but many states require collection agencies to be licensed or registered. If they are required to be in your state, then check to see if they are registered. States do this as a requirement for any business, no matter where that business is located, if they wish to conduct business inside SC. If they are not registered, and they are required to be, then they cannot legally even attempt to collect from you. It would be a violation of state law.

In either case, I do not advocate skipping out on legitimate debts, and I am glad to see that you are trying to handle this one. I would check to see about the licensing requirement, but as far as trying to communicate with them I would do it in writing. That way at least you have written record of the fact that you are making genuine efforts to resolve this.

I am having the same problem with Chase Receivables. They won't even accept anything less than the full payment on mine, and will not send me anything that says they will delete it if I pay it in full. They said it is their policy. My question is, why should I beleive that they will delete it on just their word? collection agencies lie all the time, and I have already determined they are not registered to do business in my state and they are required to be (I am in Virginia)

Welcome to the community FETTKA.

IF they do not have a business license in a state where it is required they may not conduct business in that state until they obtain proper credentials. While they may not be required to delete upon payment they must report accurately on your credit report with each payment per month. Also you can send them any amount you wish even if it's 2 cents, if they refuse payment they dishonor the contract voiding the debt.

I have been getting calls on a daily basis from them...didnt answer at first, because they ask you to press 9 then hold and wait for an operator...then I would get hung up on. Last week I had enough. I called the number back and spoke to the person that hung up. It is all over a $26.00 hospital bill that didn't get settle in my work comp case. Of course they wanted me to pay right then and there, but I asked for them to send out a statement and I would pay the bill.(This was on the 3rd) Got a call yesterday from a man there that was very rude telling me they sent a statement out and asked me if a even have a checking or savings account???? IS THAT ANYONES BUSINESS....just recieved another call, before I could say anything the lady says "Oh we called and spoke to you yesterday about this matter" and hung up...is this a joke? I have not seen a statement...bill or anything from these people except harassing phone calls all hours of the day and evening...

Send a letter to Chase Receivables informing them you will not speak with them over the phone; tell them you will communicate with them in writing only. If you're getting harrassed at work by their phone calls...tell them you're not able to receive phone calls at your place of employment. Send your letter certified mail. If they continue to call you after they've received your letter they're violating the Fair Credit Reporting Act and can be fined. I'm going through the same things and can't wait to see what happens now that they have my letter.

Sorry, this is bad information. There is no provision in the law for a "partial cease and desist". You can certainly request this, but they are under no legal obligation to actually listen to it. And, many CA's will treat this like a cease and desist....which could end up getting you sued. If you tell them to stop contacting you, they may decide that a lawsuit is their best option to collect. Not a smart piece of advice.

This is the only correct thing in that whole post---if you tell them not to call you at work, they must comply.

wow, where do you get this trash?

1--as said before, it is NOT a violation of ANYTHING if they continue to call you after you tell them "only contact me by mail".

2--the law youre looking for is the FDCPA, not the FCRA. If you do not know the law, please do not quote one.

3--there is no "fine". There is a penalty that is variable, and can only be implemented by a judge if you sue them over FDCPA violations.

If you fired off a letter that details these same things you have written here, I can tell you what happened once they got your letter. They probably laughed their back sides off at your incompetence and posted your letter on the bulletin board in their break room so all their employees could have a laugh.
