Settling out of court

I have contacted the lawyer of the bank that is suing me, as I am unable to get hold of anyone at the bank in England. I have made them an offer of lower monthly payments. If we can settle out of court will they drop the suit?


this happened to me. they did not necessarily drop the suit. what they did was sent me a letter that stated what we decided on as a payment plan and one copy went to the court. i am assuming that if i do not hold up my end of the baragin then it will go back to the court system and probably wage garnishment.

I will tell you though that the cc company lawyers were willing to work with me to set up a payment plan. Going to court is expensive and they will probably work with you.

I did not have a judgement because we never went to court. Basically the cc company just sent a copy of the letter stating how much i was going to pay monthly to the court. I suppose this is in case they need to take me to court later for failure to pay.

Of course, each collection agency/creditor is different in how they deal with things and being in England could make things totally different. This was just my experience. It wouldn't hurt to try to set up a payment plan with them before going to court.
