I had a Sears credit card that was charged off and LVNV Funding took over. I was contacting last June from a Attorney's office regarding paying this bill. They asked me to set up monthly payments which I did. I gave them 4 post dated checks for four months. After the four months I spoke to the attorney's office again in October to set up 4 more post dated payments. Well in November to my surprise I received a summons from my local court house in reference to this account. I called the attorney's office and asked why they had started to file a judgement against me after I was making the agreed payments per month. I was told it was the procedure and basically the only way to stop the judgement was to either settle the account or pay it in full. At the time I did not have the funds to be able to pay it in full and I did not want to settle it because I have been working very hard on improving my credit score. So last week was my last payment that I had set up and I spoke to them yesterday to set up a few more payments until May when I can pay it in full. They refused to accept my payments and I was told that I either had to pay a large monthly payment and still take the judgement or I could settle the account now and it would stop the judgement and it would not show up on my credit report. I went ahead and took the settlement even though I would rather of paid it in full because I didn't want the judgement on my report. I asked them to supply me a letter stating that the account was paid in full and that they would not report on my credit report that it was settled. I was told that was no problem and today I received my letter and it does state it was setttled. Arrggg I called again and was told that it was the way it had to be. So my question is once the settlement payment is processed this month I plan on calling this LVNV Funding and explaining to them what this attorney's office has said and done and I am going to request that LVNV Funding either remove themselves from my report or report that my account has been satified. I do not want it to say settled. My husband and I are buying a new home in a couple months and I do not want my credit hurt by this anymore. Any advice would be helpful. Thank you.


You kind of tied your hands by paying it off as you did. Did you ever request validation of the debt? LVNV is very well known to collect on debts they can't even prove exist!

Not to mention what the lawfirm did was very underhanded and makes me somewhat suspicious of the whole thing.

Unfortunately LVNV doesn't have to do anything other then report that the account is 'settled.' The only option I can see for you is to constantly hound them through the CRAs, keep disputing the account until they get tired of updating it....doesn't always work but has occasionally.

Let me tell you about LVNV. You know that slimy, green stuff that grows on the layer of duck sh*t at the bottom of a pond? Well, LVNV is the duck sh*t. Seriously, they are among the lowest of the low. Sounds like that lawyer isn't much better, either.

My question is: did you get anything in writing, stating that they'd report it PIF? Tape any phone conversations? Anything tangible that might support your side of the story?

Before you get upset with me... I'm not dogging you. I'm looking for ammunition against them.
