Last week I posted a question regarding PayDay2Go who had contacted my employer regarding garnishment of my wages. I received lots of feedback from you guys regarding what I should do and faxed PayDay2Go a letter revoking any voluntary wage assignment I may or may not have signed, and gave a copy to my payroll manager. Today my payroll manager gets a fax from them with garnishment papers and a copy of the wage assignment I signed. Although I have been told that payday loans are illegal in New York City, my payroll manager is clueless as to how to handle this because she says normally when they receive garnishments paper work from anyone she complies. Where can I direct her or what information can I provide to her to give her the guidelines of this issue?


(e) An assignment of wages to be earned is revocable at any time by the maker thereof. Any power of attorney to assign or collect wages or salary is revocable at any time by the maker thereof. No revocation of such an assignment or power of attorney is effective as to the employer until the employer receives written notice of revocation from the maker

Lady, you only need a court order for a wage garnishment. A wage assignment is completely voluntary and can be revoked at any time. In some of the pdl contracts they have a wage assignment clause that you dont even know is there. It is really stupid of this hr person , especially in New York, where these loans are illegal to even think of honoring it.

Well at this point I have provided the info you guys gave me and given it to payroll, she said she completely understands but has never dealt with this type of situation so she is waiting to hear from the company's lawyer regarding whether it should be honored or disregarded. This is a nightmare!

I will definately keep you guys posted, you all have been a great help to me with this matter. I'm sure had I not found this forum when I did, my situation would be so much worse. But I was able to put a stop to it early on, but they are not giving up so easily. Hopefully it will all come to an end.
