Wage assignment letter for payday loans

The date
Your name and address
The name and address of the creditor
Your account number with the creditor

Dear Sir or Madam,

I hereby revoke your right to use the wage assignment I signed on (The date you signed the wage assignment agreement). You no longer have my permission to use this wage assignment.

Sincerely,
Your signature

Make sure you give a copy to your payroll department.

Don't send this until your account is closed or they will try to hit your account for everything. I'd also send complaints to the BBB, your states AG and the FTC at the same time.

You would give this to your payroll department because it is voluntary and you would want to ensure that the payroll department knows that you are revoking the wage assignment because you would no longer want these funds being deducted from your check. I used to do hr/payroll for 10 years and I know that we had to have something in writing in order to stop a wage assignment. And if it was a court ordered garnishment or judgment it was required to have something from the courts.

ginurse:
Can you use a generic letter for your wage assignment letter for your work (1 letter for all loans) or do you have to have a separate letter for each company?

Good question! If it were me, I would actually give them a copy of each and every one, just to be on the safe side. But that's just me. :D

The office manager may have a big mouth :( , however he/she has to keep private matters private if she does not want to cause the company any legal problems. Do you have a payroll department where you could by pass the office manager? If so, I suggest you go to them. If not, go to the president of your company and let them know what is going on and tell them that the office manager has betrayed employees trust in the past.

GINURSE-
Here is the letter I used to make my HR dept aware of what was happening. In the parenthesis, just choose one and then take off the all caps.

DATE

MY NAME

COMPANY NAME Human Resources

I am writing you to advise of an illegal ???????Wage Assignment??????? document that you may be contacted about by NAME OF PDL (???????s).

The fact of the matter is that I took out an internet cash advance loan from (THIS or THESE) (COMPANIES or COMPANY) and part of the documents included a ???????Wage Assignment???????, not a Garnishment or Judgment document. After further research, it has been found that these types of loans are illegal in the state of YOUR STATE and they have no license to do business in YOUR STATE. I have sent and faxed a letter to (THIS or THESE) (COMPANIES or COMPANY) advising that I have revoked the ???????Wage Garnishment??????? document and also outlined the YOUR STATE Financial Code.

I would kindly ask that if you are indeed contacted by (THIS or THESE) (COMPANIES or COMPANY) to please contact me immediately.

Thank you

Sincerely,

YOUR NAME
