Did you dispute the account with the three CRAs? If they verify, that is considered continued collection activity at this point, you could take them to court over the violation and make them either put up, or take off plus pay you for your trouble.
Any call they make to you, any letter they write asking for money or even about paying the account at all, is also considered continued collection activity.
You will have to be a pain in the rear to them but really, what choice are they giving you?

To be quite honest I haven't disputed the amount with the 3 CRA's yet. I am so tired of dealing with these CA's I could almost scream. lol But I'm not giving up, I will continue to execise my rights. When you say dispute, do you mean to call each one, or send a letter of dispute? Which is the best way? I am in for the long haul, as I know it's going to be a long one based on the lack of responses I am getting from all of the CA's I have contacted, but it sure is frustrating. :?

There are arguments that letter writing is the best way, since doing it online just makes it easier for them to verify...but I haven't had any problems with online myself, when it gets verified I just make a copy of that. This is what I did with LVNV....will see how it works when I go to court. :)

thanks for the website. i got a letter from one of the worst agencies per the site Frederick j Hanna & associates. i am sending them an DV letter. they talk about how bottom of the barrel they are. the letter says the debt is from arrow financial. i had 3 issues with arrow financial. 2 of them they sent me settlement letters and i paid. a couple of months later another ca contacted me for the difference. i never responded. but i did not know i needed to get a letter from them that the debt was paid in full. the other was for gateway computer.
i just ordered my credit report so i don't remember when the last payment was. i do remember the last call they were very rude. they gave threats and called me dead beat. they were going to take my car, my check and house. i rent and my car was not mine. i did not get any call from these guys. unless they were the recording calling and left a message that my status has changed. my son has my phone all the time so he does not answer any 800 numbers. out on that website i read where they took peoples cars and garnished there checks. they would have to go through court right? money is rather tight right now. i care for my daughter and her son. she became very ill a year ago with lupus. so i had to move her in with me. i had to borrow from my 401k and credit union to keep above water in 2007. so now i'm paying it back now. has any of you guys delt with this ca before?

They are breaking the law telling you all those things. They can't take anything without a judgment being awarded to them, then, it all depends on your state law as to what they might take. If permitted in your state, record any further conversations with them.

Hanna hit me today with a garnishment over an old debt that I tried to defend Pro Se. I never denied that I owed the debt and made a settlement offer, but they weren't interested. On top of everything else, they added $4,000.00 to what they claimed I already owed.
Nothing like being kicked while you are down. They seem to be experts at doing that.
