Sears is funded by CitiBank. Citibank sells off their debts when

If LVNV is collecting on behalf of CitiBank (pre-charge off or early out) Then you should be able to call CitiBank and request statements for up to two years I think. I know that if it isn't charged off you could be facing over the limit fee's, interest of about 32% and late fee's up to 40 bucks. And that is something on the account you can't dispute.

Then contact each creditor with a copy of the police report. If someone used your information then I fail to see how it is CitiBanks or LVNV (as bas as they are)'s fault.
Your ID was stolen from what you are saying. There is no telling what else might be out there in your name so it would be a good idea to get on top of it.

As for the debt in question, dont worry--take a deep breath. There are things for just this situation. You need to send a debt validation request to LVNV by certified mail, return receipt. If you need an example of what this letter should look like, there is one available in the do-it-yourself section under "sample letters". Type up a letter like that, be sure to include any account # that LVNV provided, and send it off certified mail RRR. it MUST be sent certified mail, so you will have a record of when they received it. It is then their responsibility to get validation of the debt, to prove it as yours, and then send that to you. They cannot continue trying to collect on the debt between the time they get your DV letter and the time they send you the validation.
It is true that a lot of collection agencies suck. But, before you jump the gun, lets remember that they are run by people and people can make mistakes too--thats why the law exists. Send off that DV letter and let us know what happens from there, and we can help you sort it out.

Fyi..I assume this is not the credit card company you represent and make a living collecting from?..you aren't making money here so you protest ? very obvious to all here who have researched@!.. I can honestly say not being in the business that my sears card is one I respected for honest transactions in past ten years! of course I have never had anything charged off..but have always had nothing but great and awesome dealings with this particular company..who do you represent Fyi?..please let us know here!

Seriously?? Aren't you the same person who didn't read what FYI had to say, and then blew up at her? I have seen nothing but solid and consistent advice from FYI. If you don't like this person, be an adult and ignore her...the internet makes this very easy to do.

socks, with all due respect, you're stepping over the line with this.
FYI is a very well-educated and highly respected member of this forum. She has never once hesitated to talk about the illegal methods that many CA's try to use, and she has NEVER ONCE, that I can EVER recall, given bad advice that was biased towards the debt collection side. Her posts have helped plenty of people, myself included, to become more educated on how to protect ourselves from such illegal practices. Hell, she even commented in the post above about "as bad as they are"....she has never had any problem admitting when she sees fault in the collectors that are discussed here. So, I respectfully ask you to tone it down a notch or three with her.
She read the original post, and concluded, as others did, that this person is possibly the victim of identity theft. And her advice was spot-on--it wasnt designed to favor the collector. She told the OP exactly how to handle the issue the right way and how to protect themself against any other fraudulent use of their identity! What exactly was wrong with that?
My friend, please, let's not see things where they arent. FYI has been in favor of consumer's rights from day one in here. Let's ALL not forget that debt collection is a very real and necessary business--this site does not dispute the collection business! Instead, we dispute the illegal tactics that are often used in the business. There are no doubt good collectors and good CA's out there that follow the law--and you dont have any right to lump them into the same basket as the others.
Rememebr this--we advocate paying your legitimately-owned debts, and we advocate working maturely with any colleciton agency that chooses to do business properly. This isnt a beat-down for all collectors here. Please dont try to make it one.

I totally respect all comments on this forum and am sorry have stepped over line..I just don't trust debt collectors and especially not debt collectors who say they are here helping someone else..now I respect anyone in any aspect of life who comes to bring opinion to the table..but I am sorry for suspecting someone in the business that 98% of people on this site has horror stories of how badly they were treated and got
the fact that I don't trust debt collectors on this sight is the reason I will not be back very much in the future..but will continue to check back once in a while to touch base with all the wonderful people and friends I have met here..I am just so tired of being called the bad person here..because I assumed another debt collector was here for the wrong reasons..the sight is here to help people in debt and to help people pay off their obligations they owe..I am well aware of that...
sometimes I have felt love for this person in the debt collection field who is here to help in her words ..and..sometimes after researching this person's posts and reading all posts from day one...I do not trust at all..and I am not sorry for that...I have not made one penny from debt collections or posting on this site and never will..and once again thank you to all who have been my friends and realize that my time spent here has been to help others..After my first week on sight after my first visit when everyone else was SOOooo NICE TO ME! and I felt need to stick around and PASS IT ON!!!!! also..my last response on this subject would be to skydiver..

it is okay for FYI to generalize about her thoughts on bad collection companies whenever she feels like it because she doesn't work for them and only her company does the right thing? because she obviously doesn't collect for them the two she bad-mouthed (and I actually contacted Citi today and am having them look into her statement here after you said I was in the wrong.. morning sky and mom).....my statement and fact is that I have had an extremely wonderful relationship with Sears and Citibank..and am very happy with my dealings with them.. (And yet..citi affiliates giving my daughter in college a total of three credit cards is the real reason I originally found this beautiful sight)...my take on the situation is a person in the collection business has no credibility slamming ethics of other companies in the same business (in my book at least)..take care mommom!..I don't expect you to even understand but I know for a fact that others here do!!!!! and if I should be banned then ...so should you ...so there!!!!!! :D :shock:

I felt I was doing the right thing here and apologize ....because I do not want to be on the offensive here ..I just get so upset when I feel people are being duped or taken advantage of.....when I saw the statement that implied Citibanks are bad...I thought Wow! that's just like saying "All debt collectors are bad" or "All Czechoslovakians are bad" and on and on..the generalization is wierd from debt samaritan....not trying to get distracted or be mean...and I apologize for thinking that someone is extremely Narcissistic to be a debt collector here helping others and I do apologize for the fact that I have believed in so many others here but still feel there is a hidden agenda..Mike I sent out several e-mails to many Citibank and Citifinance... people encouraging them to visit site where their name is being mentioned hope that is okay and I apologize and will just from now on when I come to site stick in threads where positive things are happening!
