SORRY THIS IS SO LONG, BUT I THINK IT'S WORTH READING IF YOU HAVE BEEN STRESSED FOR SO LONG AND THINK THERE IS NO JUSTICE, AND YOU NEED TO FEEL YOU CAN BREQAK THROUGH IT.

I dove right in to the online payday loan nightmare about 8mos ago...and at last I've finally prevailed. I started coming to this site and I've gotten so many ideas on how to clear myself of these blood suckers. I had a Loan out with B.I.G for 200 w/ a 235 payback amount, I've let them take several $35 "processing fees" out b4 I realized there was no end, so then I went to AIP for a $200 payday w/ a $289 pay back...which they then took 45 for "processing" and 44 for "extension" on the payday which totaled out to 89 a pay period.... it was out of hand. I then came here and got info on the FL law about payday loans, and did all the research I could. I closed my acct from B.I.G and to no end they would call my work EVERYDAY 6x a day, I finally picked up, and told him to stop, and he said I was trying to steal, I told him they feed off ppl in desperate need, and who don't know the laws and take advantage. He the proceeds to tell me I owe over $1100.00, I laughed and asked him if he was out of his mind, told him I new the law, and that there is no way he can walk into anyone's legal system saying I owe over a grand for a $200 loan. He got mad at me and told me he was going to call my supervisor, I got Furious and told him I dare him to. I said I consider this harassment, and he is being recorded and that he is being a threat to me loosing my job, he said I don't care I'll get you fired, and that's when I told him I will give him my email address send me what ever documents he had so that I can send them out to report him and DO NOT CALL ME AGAIN I'm finished w/ you and you all won't see a dime and hung up. He had the nerve to call me back, but he was much calmer, and said he won't call the job anymore, but if I can set up to pay another $35 processing fee..I laughed and hung up the phone and received no other phone call again. AIP drew the line when at this point has taken 3 fees of the $89=$267, but they had the nerve to take one day, $89 and then 45 more which now gives them $401.00 ... That was it. I got a print out of the FL law, my bank statement to show the w/drawl, sent them a letter requesting that they send me whatever signed documentation of my loan, w/ my signature or an e-signature (which there was neither. I wrote in all caps and highlighted at the top, DO NOT DEBIT MY ACCOUNT ANYMORE, then I went on to say that they made a $112. profit off of me, sent along the copy of FL laws of lending , and high lighted where it says, no Roll over are allowed. and highlighted Where it says "written agreement is MUST before providing Deferred Presentment in FL, which I have NOTHING that I have signed. I told them to send whatever they could so that I can send it to the BBB, then State Attorney General, and also my bank and Fl office of Financial Regulation. Well Well well.... low and behold I get a call saying that the rep and her manager looked at my account and b/c I'm so delinquent, that "they" have decide that my account had been charged off, and for me to call them back to confirm. So what do you think Charged off mean? They have given up right?! I was so happy today!!

your story sounds a lot like mine. i had a pdl call me telling me i owed them about $700 when i had already paid back about $700 on a $300 loan. i informed them about the laws in my state and they e-mailed me back and said they would settle for just $90 more...i said nope, you will not get another dime from me...never heard back from them since then....this forum is great and is educating people on these loans and the more we are educated, the better we are at sticking it to these pdl companies...

I am so happy for you SWURVY! If I am not mistaken, "charged off" means that they were unable to collect that debt from you (if I am wrong, someone please correct me), and it is probably on your teletrack record, which in turn means you probably won't be able to get anymore payday loans. That wouldn't concern me, because I personally would be better off not being able to obtain anymore payday loans. What would concern me is, if they put it on your credit report, in that case I would dispute it until it is removed. Based on what I understand from reading your post, you have more than paid that loan in full and it seems to me it would be illegal to put that on your credit report as "charged off", I would think that would be a black mark against your credit report, that is IF it appears on there. Guess I would watch for that, just in case. I understand that most PDL's don't report it to the three (3) CRA's, but it has been know to happen. Anyway, CONGRATS in your success!! :lol:

Swurvy, I hate to tell you this but charged off means that they are writing you off and you will most likely wind with a third party collector. Not a real big deal, you will just have to send a debt validation letter and have them prove that the loan is legal and the balance correct which they won't be able to do.
