Hello everyone,

At the advice of another, I first posted my problem on the Rip Off Report on Feb. 6th '08 but, amazingly, not one person has remarked on my situation and I can't wait much longer. If you'd actually like to see the long version, PM me or something and I'll direct you to that post or e-mail it to you. As this problem pertains to my credit score and History on all 3 of the main bureaus, I thought I'd post a shorter version here. If a Moderator feels this should be in another section, please feel free to move it or let me know where to re-post. I'm here for help, not trouble.

First, let me deliver the punchline and then the background to it.

In November 2007, I checked my credit score with all 3 Credit Bureaus. We were re-locating so this was in preparation to an Application for a new apartment - we needed a min. Credit Score of 600 or would have to pay a lot of deposits and require a co-signer. Well - My score was now 586! Just back in Feb. '07, my score was 707, so I took an alarmingly big hit. All but one financial institution had reported me as up to date and in good standing. Bank of America, on the other hand, reported me as 120-days past due and made no mention of my documented Payment Plan starting in April '07 to the Bureaus. Needless to say, they did not report any of the payments I had made since April '07.

Unfortunately, during the payment plan and prior to this arrangement, I paid in cash at a local branch. Due to my own stupidity, (and a weird cat) I was only able to save 2 receipts from this period. I figure that at least the surviving ones from April '07 and July '07 contradicts their claim that I didn't pay at all. The local branch doesn't maintain records of customer payments without receipts (for reference numbers) for Security purposes - how convenient, no local ledgers. If I had even a hint that BoA would try to burn me, I'd have taken extra measures to not only pay in a different way, but better protect the receipts. Live and learn.

For a matter of record, both BoA and GC Services have currently been attempting to contact me by telephone and mail simultaneously. Seems BoA isn't even fully aware that GC Services took over my account or how BoA had reported me as delinquent for all those months. I'm quite confused by this - is it in Collections or isn't it? They make verbal and written threats against my Credit Score and Reports like they haven't done anything yet but they already have - it's documented. It's akin to a mugger who has shot you before even demanding your wallet, only to then demand your wallet or else he'll shoot you.

Feel free to ask me questions as I have shortened this and questions will no doubt arise as a result. I'm not trying to cheat a debt - I know what I owe. The issue is that they took my money and ran while reporting me as a bum.


In the meantime I would suggest disputing this info with the credit bureaus and atleast provide the proof you have! They have to get back to you within 30 days. You are also allowed to mail a certified letter to BofA disputing what they are reporting to the credit bureaus and they legally are supposed to show that dispute letter with your credit file. It may help.

I'm the OP here. Sorry. I thought when I posted that I was still logged in. Thanks for your help, frogpatch and smckaybiz. It's greatly appreciated.

Now, with the Office of the Controller of Currency, do they also deal with Banks in terms of Credit Card Services? My regular bank is not BofA. They were simply whom I got my Visa Credit Card with.

This is somewhat off-topic but about the weird cat I mentioned - some explantion. The cat didn't eat the receipts or anything like that. Instead, we found that he'd developed a habit of taking small papers he would find around the apartment into his hooded litterbox. Most times the papers were to be trashed anyway, so it was more of an annoyance than a problem. At one point he did take a dollar bill and a few of the BofA receipts in there. If I'd known that I'd have my problem with BofA, I'd have saved them regardless. At the time I didn't think it was important and that things were square between us. Anyway, he stopped doing this once we gave him a coarse rug to wipe his paws on. We figure it was mimicry - he's a clever cat, sometimes too clever.

Hi! just to give you an update on this issue, Retroflow had located some bank statements noting payments made directly to the local branch for his BofA credit card. These payments were made after the "last payment made" date uttered by the collections agency.

Is there anything we can do at this point? BofA seems to have provided incorrect information to GC services, either that or GC services is making up the information. Any advice?

So who is reporting it? BoA or GC? Also I'm a bit confused, is the credit account delinquent and you are making payments? I see you mentioned a documented payment plan that should be able to help you as well.

I don't see how BoA can't be fully aware that a CA is trying to collect from you...this whole thing sounds just plain..wrong.

The fact that this wrong information has cost you an apartment (this was in NOV right? How did the apartment leasing go with your current credit score?) can also be used if you have to fight these guys.

Why are they both trying to contact you? You are still making payments correct? I think something is seriously wrong that they don't keep records of payments...I thought they had too.

The account as of right now has not had payments made on it, as we're not sure whether BofA is stil accepting payments of not. I know at this stage when this happened to me (between BofA and GC services, I went thru this last year), BofA wouldn't take payments but still contacted me.

Retroflow has been out of work since August, and has had no income since then. I am already taking over a car payment and auto insurance that are honestly not in my budget. I can't take on anything more than that.

As for the apartment, because I work for a company that does advertising for apartment communities, and our relocation was due to my job transfer, we did manage to get a lease on an apartment through a recommendation from my company (thank goodness!).

So to answer your question, no, payments are not being made as of right now. But we do have documentation about a payment plan effective May 2007, and we had stuck to that payment plan through November of 2007, when, basically, money ran out. However both parties are contacting us at this point. Not sure why. All credit reporting agencies show no record of the payment plan, in fact, no record of payments since May 2007 when the payment plan was put in effect. We have documentation from B of A about the plan, and we have the credit card statements showing that payments were made.

Something is totally wrong with this whole situation. I'm ready to take on GC services myself, but I'm never home when they call.

I'm going to start the process myself of sending a request for debt validation, etc..
