I was recently served with a Sheriff's Entry Of Service Summons, that I was being sued because of non-payment on a credit card that I had not made any payments for over four years. This credit card was sold to Worldwide Asset Purchasing, II, LLC by the original card owner. My questions is does the statute of limitations SOL offer any defense in my case, as I have 30 days to answer to the summons and file it with our Superior Court Clerk with 30 days or the firm will be given a default judgement. What steps do I need to take, I need a "blank" letter of dispute with SOL. HELP PLEASE!


You need to either admit or deny each of the allegations on the summons and return a copy of it to the Superior court clerk before your 30 days is up. Make sure that you keep a copy of everything.

Once you do this, send the company a debt validation letter, make sure that you send it certified with a return reciept requested. File a copy of this also at the courthouse and KEEP copies of everything. Hope this helps you, if you need more information, come on back.

i recently got a notice from a collection agency that i owe a debt opened in 7-4-2000. have never remember opening this account. after 9 years they want me to repay. they purchased this in 6-2007. i sent a valadation to them my name and ss is there but i do not know who this is. what do i do now

What state do you live in? Look it up here and look under open accounts if this is for a credit card.

If for instance the statute of limitations is 6 years and it has been more than that since a payment was made, send them a letter to cease all collections and phone calls.

You say you sent them you SS number? Not a good move if you did, you have to be careful with these bottom feeders. Who is the collection agency?
