Pacific Creditors Association

1 day in november i randomly got my free credit report and I saw there was a collections on Experian for $1840 So i wrote down the Account and the name of the CA and called them and figured out the Collection was for a Vehicle that my mother put into my name and got impounded and since the car was a POS my mother let it sit in the impound since it was more to take the car out then the car was worth. I guess she thought that that was it since she has had cars impounded before and nothing has happened. But lo and behold they sent it to collections and now I owe $1900.
Ive thought about taking my mother to court but i now live in CO this all happened in CA. Plus I would think even if I went through all the hassel of taking my own mother to court and all the expenses and heartach that would bring my mother is broke anyways.
I really am at a lost as to what to do. I just cant afford to settle $1500 or really pay them $200 a month plus its very hard for me to pay a debt that in all reality i had nothing to do with.
Any help would be appreciated.
P.S. I was never contacted from the creditor they actually dealt with my mother for a couple months i guess and I basically would of never known about this if I hadnt checked my report. Now the collection is on all 3 bureas.
I have the same problem
I am actuallygoing through the same thing with the same company...what did you end up doing?
Pacific Creditors towing claim
What is the status of this claim against you? I am a lawyer in SF who recently won a decision against Pacific Creditors and Experian. The US Court of Appeals for the Ninth Circuit agreed with me and Ms Pintos, my client, that PCA did not have a permissible purpose to access her credit report. Did it access your credit report as part of its effort to collect? You may have a claim. contact information removed

This is probably getting off the subject. How do you know if someone has permissible purpose to access your credit report? I have several collection agencies that have accessed my report and it always says "premissible purpose" even though I never actually signed or gave them permission to.

Collecting on a debt gives them permissible purpose.....you dont have to give them permission. And to the attorney above, read the OP's post.....she is being charged for impound fees so she owes a debt...and PCA is listing it on her credit report.

no, this is two different people we're talking about. This was put on a person's credit report, but that person's mother is the one who got a car impounded. They are coming after the son/daughter and that is whose credit report this has been placed with.

That person couldn't sue his mother and win anyway, even if he buckled up and faced the emotional difficulty in such an action. The vehicle was in their name, they left it behind, it got towed, she didn't spend the money to get the car out (and didn't need to, it isn't her car). The only way they could possibly have a case is if it could be proven that she willfully and with malicious intent parked the car where she knew it would be towed (like in front of a fire hydrant, for instance). Cars aren't just towed for no reason, my guess is that the tags expired.
Tow fees are very expensive, $1800 sounds about usual.
