Do internet based payday loan lenders with no physical location in FL need to be licensed by FL to lend legally to FL consumers? I am trying to help a friend with a huge mess. She has several internet payday loans, and they are saying that they only have to be licensed in their state, and that they can follow the laws of their state, not FL's laws. What is correct? Any information would be very much appreciated!

She can file a complaint through our website at flofr.com and under 'helpful information' click on file a complaint. Then click on
finance related and you can download the form. Or click on money transmitters and call the 1-800 number. The Office will review her complaint when received. All lenders must be licensed by Florida, regardless of location, however, the current payday loan laws in place do not address internet businesses. The department is currently looking at other laws to apply to them.
She may also wish to contact Legal Aid in her area, to determine what recourse she may have.

Looking at your loans they are all paid off and over paid according to your state law except Quick...where you still owe about $68.00.
You can find letters to send to each of them revoking their right to debit your account, stating your law and requesting a paid in full reciept. Any questions just ask!!

Thanks a lot, you don't (or you actually probably do) realize how much better I feel today than I did yesterday. This is literally killing me.
So if I have this straight, I should:
1. Send letters to the PDL companies revoking telephone contact, wage assignment and debiting my account.
2. Get account closed, or open new account. Making sure that the old account cannot be re-opned when the next batch of ACH hit.
3. Go have a heart to heart with my payroll director, giving her copies of all correspondence andmaking her aware of the laws for the State of Florida and to not assign wages to these PDL compaines.
Am I leaving anything out?

Ok, here's an update. I went to the bank this morning. I had to wait until today as I had a car insurance debit I did not want to screw up. I knew that as of this morning everything would be clear and all legal/authorized debits would be finished.
I opened a new account. Transferred what little money was in the old account to the new account. All of my checks have been voided and my debit card as well. It will take 48 hours for my bank (which is actually an investment account) to generate a new checking account number as well as a debit card and checks.
I have been assured by 2 different employees that no ACH can re-open this account, and that nothing presented will incur an NSF fee or "re-open" the account.
All I can do now is hope they are telling me the truth.
I have filed complaints with the Florida Attorney General realting to each individual loan.
I have written C&D letters to each company pertaining to each individual loan. I used the one I found on this site as a template. I will mail these letters today. I did not want to mail these until I was positive that I had all my ducks in a row pertaining to my bank account.
Is there anything else I should do at this point?

I did have to call the bank today as I had not received a new ATM card yet. I had to answer some security questions...... I wonder if they were ever going to tell me that! So another week without ATM.
I mailed a ton of letters today.
C and D to all companies.
Complaints to Florida Department of Finance.
I also spent all morning filing complaints with the BBB.
I sent a letter to my head of HR at working stating she is not to speak with any of these people, that these loans were illegal in the State of Florida and under no circumstances is wage assignment the same as a judgment. She was very understanding.
I haven't seen a whole paycheck since last June. It felt great today to regain control over that!!! I can pay my rent and not have a sinking pit in my stomach feeling.
Again, I really REALLY thank you for your help so far. It has made a seemingly hopeless situation somewhat more pleasant.
The hell hasn't started yet but at least I'm not hemoraging $1600.00 a month.

I would let them go to voice mail or take messages for myself. I would note the date, time, who called and what was said and then I would fire back an e-mail with the information and a copy of the letter stating to contact me in writing only. We are here if you need any help dealing with them when they call. You are doing great.

With luck, many of them will abide by your request to only communicate via email (we can hope anyway!). And, honestly, you don't want to take their calls if at all possible. You have no documentation of telephone calls. Try to get everything in writing.

Thank GOD my bank is strict, once an account is closed that's it. NOTHING can re-open it. I do feel bad that they are wasting $.33 every time they mail me one of these. I am going to have to buy a file cabinet just to hold all of these, especially if this goes on for moths. B@stards! I had 7 loans out and they tried 14 times.

Just starting the process
I just discovered that there are three (3) thieves trying to withdraw money from my bank account. They are: SSM Group LLC, QuickBucksDirect and Sagamore Bb Pro. Each one is trying to get $60 at a time twice each month. I brought a letter into the bank today instructing a permanent freeze on the account to block these three from withdrawing money. The letter identified their activity as illegal and unauthorized. I am now preparing all of the information I need to send with the complaint to the Attorney General for the State of Delaware. I wil then followup with a complaint with the BBB.
I have found this site to be quite helpful to me. The information also re-inforces the process that I've begun. Thanks for sharing this very helpful information.
