CA will not work with me this month.

Some of you know, I had a debt with Cash call, for a while. Another CA 'owns' my loan now. Well..my problem is this. I called this CA yesterday and asked if I could lower my payments with them, this month. My hours went down, a bit, at work. As I was talking to the Rep., of course, he went into the spill that, " they are doing me a favor, and lowered this and lowered that..BLAH,BLAH,BLAH. I told the Rep I appreciated everything they had done for me, however, I'm in a bit of a jam and I wanted to work something out. The Rep said their, "hands are tied and they cannot take anything less than the ORIGINAL monthly payment." Well....I just told them I KNOW they have to take SOME payment, from me, per month. That's the 'short' of it. I know, from personal experience, if anyone sends a payment to a CA, they HAVE to take it. So...I'll just pay what I can, per month, and keep all of the receipts. Anyone have any OTHER suggestions, for me?


Actually, they don't have to accept anything, though generally I would say I have never heard of a CA refusing a payment, I just read about a payment being sent back not to long ago.

They will likely try to get aggressive with you to try and force payment. I bet you anything they will threaten to report this to the credit reporting agencies, that is a typical tactic..but you can turn it around on them. If they do threaten that, you can counter with threatening to stop all payments, that if they were going to be pissy and report it, then you would just stop paying them altogether.

They could also try taking you to court. I would send in a payment, CMRR and if they send it back, keep that for your records so if they DO try to sue, you can show nthe judge that you had been making payments, but when you didn't have quite enough one month, they turned unreasonable and refused the payment.

I send them payments, through Money Grams. I have EVERY single reciept, from making those payments. They DID ask me, at one tome, to give them my checking account number. I don't give that to anyone!! So...I'll continue paying what I can, per month. When I send Money Grams, the payment is automatically (electronically) put into my account, with them. But, I'll keep receipts, too. Thanks for ya'll help.

While I was reading your first post, I cringed as I was afraid they were automatically debiting your bank account. I had visions of the nightmares that could possibly develop due to this.

Thank goodness you are sending Monday Grams.

GoldenBast is correct, they don't have to work with you at all; however, I would think it would be in their best interest to do so. Granted, they would love the entire amount up front, but hey, if you had the full amount they wouldn't be bothering you in the first place as you would have already sent it to the OC.

I would like to win the entire lotto drawing this weekend too, but that's not very likely to happen either. Probably 'cause I don't play. Funny how that works.

So, do send them whatever payments you can each month. If they do return them to you, which I highly doubt they will, then make sure you hold onto the evidence in case you're sued. It sounds like the money you try to send them is sent electronically? Would you get it returned that way if the CA didn't accept it?

Anyway sounds like what you already plan to do. Be sure to keep us posted as to what happens.

I once had an account that I was paying $50 mthly pmts on. Once I could only pay $30 for that mth and they said that it couldn't be lowered. Like the others said above, when I sent in the $30 pmt, they applied it with no problem. Most of the CA's will tell you that they can't accept it, but they will once they get it. Just send in what you can afford, and if they apply it, be glad. I don't really see them sending it back to you.

My payments are sent by Money Gram...which just like a Western Union. I go to a place, like Walmart, and send the Money Gram. I don't know why they would send a payment back to me. If they do, they would have to send by check..I would think. Wow!! This'debt is ALREADY on my Credit Report..and reallt can't get any worse than that. Hope this makes sense to everyone.

Its on your credit report? Hmm. Who put it on the report? When I do enter into a payment agreement, I make the CA send me a letter saying as long as I make monthly payments, they will not report it. Boy do they whine and cry about it though:)

Since it is on your report, I wouldn't sweat it..what more can they do? Send you to court? yeah..the judge is really gonna appreciate them waisting court time because instead of $50 you paid $30 one month. :)

When Cash Call 'sold' my loan to a CA, THIS is the CA I'm dealing with now. So.....the debt, from Cash Call is ALREADY on my credit report. The CA cannot legally charge the 99% rate, that Cash Call was charging. Sorry if I wasn't clear on that. According to the CA, when I pay the loan off, with THEM, they will 'update' my credit report...hopefully. If not, I'd have to 'update' it myself. Hope this is a bit more clear.
