All,

I have my DFS account in collections with this lawfirm and have been advised via phone that will be filing suit. When I first called to work something out with them the rep handling my account stated that they (Dell) are not interested in monthly payments I offered her for the time being $50 a month on a $2062 balance. Then she told me I had till 2/20/08 to settle but for the full balance. Told me to borrow money etc after I explained my situation and all that. 2/20/08 came and went but I did follow up with her and told her I do not have that kind of money again and we could work out a payment plan and after reshuffling I would have an extra $100 bucks a month to pay towards this debt. She said it could be accepted but I would have to pay $500 up front and then $100 every month but a lawsuit would still be filed because if payments were missed etc they could still come after me. I had till today 2/25/08 to give her my reply. It was a frustrating weekend trying to figure this all out not have $500 to pay towards a balance that interest would still accrue regardless of the payment plan.

I know I shouldn't do this but I called back today and offered a settlement of $1031.25 payable in 3 payments. First payment could be taken the end of this month, then march 14th and march 31st based on my pay schedule. The reason I offered this arrangement, we were informed we would receive a bonus this month that would be in our month end check. Which works out perfectly for me to settle this account so I would not be sued. Granted I still have other outstanding debts but I just want this resolved and have been reshuffling payments around just to take care of this. After speaking to the rep she stated Dell would not settle for less than the balance. I asked why is that if it has been charged off why would they not accept a settlement when other creditors that I am working with are willing to do so. She just repeated herself that Dell Financials would not accept any settlement offer for less than the balance.

Has anyone run into this type of situation? What suggestions do you have towards this issue? I am at my wits end on this one and I do not want to be sued. I have documented our conversations not recorded but what was discussed a summarization. I never heard of anyone not accepting a settlement. Can I call Dell about this and see if they accept the offer?

Really, I was not sure about that. Thanks for the information. I just received a call from JBR rep today at work and at home stating I had till 5pm today or papers will be filed. What I just noticed on the papers was the first letter that was sent to me dated 9/5/07 had a reps name on their from the law firm, which is what prompted me to send my debt validation letter but they did not respond till 1/29/08 and on this letterhead it had the attorney's name Bruce A. Block. What gets me is that it took 4 months to send the information which in turn was only one statement and now they are threatening to file suit. They do not have a good record with the BBB either and there address is different from their first letter now. Can lawyers/collections refuse settlements? Is that allowed?
