Help with payday loans
Date: Tue, 02/26/2008 - 11:04
I have 10 outstanding payday loans. I just recently put a hold on all ACH deposits from being taken from my account. I have contacted the payday loan places that have contacted me stating they havent received payment. I told them I no longer have direct deposit and I would be paying by US mail. I requested there address and also a billing statement to be mailed to my address. One company already said they do not accept payments by mail and gave moneygram information. Is it me or does this not sound right? I do not want to pay the charge of sending moneygram. Also I live in Massachusetts, what exactly am I required to pay back. Thank you

Rebekaus,
Welcome to the fourm. First, be sure your account has a debti block, not just to ACH, the pdls are tricky and will send paper checks through to get their money. Second, as far as I can tell, internet pdls are prohibited in your state (pleas someone correct me if I am wrong.). I read several threads that stated that. What this means to you is that you only need to pay back what you borrowed. Here is the Payday loan laws for Massachusetts (just select your state),

If you would list which companies you borrowed from, how much you borrowed from each and the total of how much you have paid to each...we can help you deal with this. Many of us have been or are in you shoes and we have dealt with many different companies. We will be happy to help you do the same.
The pdl companies are often difficult to deal with. They will tell you anything just to get you to pay them what they think you owe. It is not unsusal that they will only accept moneygram...however, if you list the information requested, it will help us to know where you stand with each company and then we can help you with dealing with them.
Rebekaus, pdls are PROHIBITED in your state, as roxy pointed out
Rebekaus, pdls are PROHIBITED in your state, as roxy pointed out. This means that they are lending illegally to you. Your first step right now is to get a HARD DEBIT BLOCK on your old account. Not just an ACH block. An ACH block will block ACH debits; however, these pdls will change their names, their amounts, their dates, etc. to get debits to go through. They will put through electronic checks. Put a HARD DEBIT BLOCK on that account now. You need some help with your pdls, okay? What you need to do is list them out by name (we know they are all going to be internet unless you crossed state lines and went to a storefront somewhere else). Next to the name of the pdl, tell us how much you borrowed (principle amount only) and how much you have paid back (total so far to date). Once we have this information, we will get you some information and get the ball rolling to help you get out from any harrassment from these pdls. And, you are correct in questioning them telling you they won't accept mailed in payments. No. You do NOT have to send Money Gram or Western Union. They cost money. Let's see if you owe these people any more money and how much if you actually do. Please list out the names, principle amount borrowed, and how much you have paid them. We can help you with this. First, call the bank and change the ACH block to a HARD DEBIT BLOCK. You want NOTHING to go through. Post when you get your information and we can help you. :D

Hello, Thank you very much for responding. I will email back with the loan company names/amounts on this Tuesday, need to print my bank account information and go through it to get correct amounts.
thanks again, the phone calls are coming in and I want to resolve this quickly.

I'd also add something else that I've seen on this forum; check with your bank and make sure they don't charge return fees on the ACH's, or you'll wind up with a lot of overdraft fees! (thank goodness for this website, before I went to my bank, I wrote down a whole list of things I found here I might not have thought of otherwise!)

Hello,
Does it matter what state the loans originate in, yes I live in Massachusetts, but the payday loans themselves come from a variety of different states, none of which from Massachusetts. Please respond soon. I contacted one payday company from NH who said they are legal and I have to abide by there state laws. Please help this seems to be more and more complicated.

Your state laws are the ones that matter. If does not matter where the loans came from. Pay Day Loans are not legal in the state of MA.They will tell you that you need to abide by their state laws. It is not true. It is your state laws that prevail.

Rebeka, Listen to Kash, they will tell you that you have to follow the laws in the state THEY are in which is not true. YOUR state law is the one that needs to be followd and in your state they are prohibited. If you can, please list the companies and the other information requested. There are many of us on here who have dealt with the internet pdls and we can help you with dealing with each company.
