What Tremont does is sue you in their county. Not yours. So most people think "Well, I can't get there to show up for court." and just ignore it. Tremont gets a default judgement and from then on it's an uphill road to get things reversed.
Thing is, Tremont should be suing you in your county. If you receive a summons from them, answer it with the facts! The judge should throw the case out from improper venue.

Hello,
I would like to know how to respond to a summons from South Dakota for Tremont Financial, LLC.
Thank you.

Here is a funny story about Tremont Financial. I did take out a payday loan with them in 2009. My payment plan was going fine. I had lost my bank card and notify them that I had to wait 7 to 10 business days to receive my new card. They were fine with that. I was behind in other bills in the process of not having access to money (This bank card is a prepaid card from account now).
When I received my card I plum forgot about Tremont Financial the last payment owe was only $90.00. So I went in an checked my acccount and saw that that from my old account that they had deducted $120.00 from my account. So, ok the 90 bucks was paid and that was that. Recently about a month ago I receive a call from Tremont Finacial asking me about my debt and that they are in the process of filing suit against me. I told them that their is an error somewhere that I paid my debt on this loan.
This was a women in their legal department that said she will call me back she had some other paperwork that she had to check and would like to make sure that it was correct. Never heard anything else since then.
I am working and I get this elderly man come into my office and serve me papers from Tremont Financial. As this man was leaving he suffered a heart attack (Yeah unbeliveable). He is fine.
Later I was able to look at this summons and noticed that it had been filed in the state of South Dakota, county of Minnehaha the amount was for $414.12. I got online and pulled my bank records that show this was paid. I contacted my bank to go over my account and they verified that money was debt from my account by this company.
I printed out the information, contacted Tremont's legal department, asked them to pull my files and lets figure this out. When my bank closed my previous account due to me losing my card Tremont went to debt for the $90.00 dollars. They had received insufficent funds and tried seven days later and my account was closed. So I had my bank on another phone line asking how could it show on my account that it was debt in the amount of $120.00 and cleared. I am explaining that now I am being sued for the balance that I already paid due to an error on your part.
Account now had transferred me to another department which I recieved and apology. they did not transfer over the money to my new account. It was left sitting, so with the mix up of it all my bank paid Tremont and Tremont settled and took the $90.00 bucks and everything worked out.
I requested for Tremont and Account Now to send me a letters stating the misunderstanding and what was accepted. Which they did.
This is the kind of luck I have!

The trouble with Tremont is they get that small claims judgment in their home small claims court and then send it to your employer. Your employer may not realize that a South Dakota court has no jurisdiction over him and pay a garnishment. Even if he does, the company is counting on you being so embarrassed by the boss knowing your situation that you'll pay. Real bottomfeeding creeps. Especially that Brad Vanderwoude in their collections department.I'm surprised this thread is going. The last time some of us tried to talk about these creeps with their b.s. small claims suits, one of the mods came in, called us all a bunch of "trolls," said we were making it up because "illegal" lenders never sue and locked the thread.
