Does a CA have to be licensed in your state in order to attempt to collect a dept.

Also is there such a thing as fax numbers for the
BIG THREE

Thanks

Hi kasmand--

first, each state has its own laws as to what they require for businesses or collection agencies. Many of them require that a business, even one thats outside the state, that wishes to do business within that state, must be registered or licensed. You can check with your state's secretary of state office in most cases to see what they require. Or, if you list your state, and the CA in question, I can check it out for you.

Fax numbers, not sure, but there are two ways to contact them that I do know of for certain--by phone and online. If you already got your credit report, you can go online to file a dispute and it's faster than mailing it. If you need a copy of your credit report, a fax machine wont help you anyways.

I have lvnv messing with me. Call LVNV, Resurgent answers. Bay Area Credit Services LLC who is associated with one or the other is also calling and mailing me letters.
The NE AG site lists Bay Area Credit Services of SC as being licienced in NE.
My question is, does that make them all able to try and collect legally?

Only companies that are licensed may collect (if your state law has that stipulation where they must have a business license) if they have another agency that is licensed to collect then the licensed agency may attempt to collect. If LVNV funding has no license for that state then they may not attempt to collect directly.

Just make sure this is your debt, the amount is right, and that they are legally able to collect on it, this can be done by sending them a debt validation letter, certified, return receipt.

Whatever you do, don't make payment arrangements or give them info such as SS numbers, and Bank info--until you are sure that this is your debt and they can collect on it.

If you have any questions, please ask.Karen
