Can payday loan companies take money out of my check if payday loans are illegal in my state?


how do they do it? Long story short....i owe 9 payday loans and my car was broken into this past week-end, i had to close my bank account because they also stole my wallet and a 1000 out of the account. What do i do now. I want to pay them off, but there things are going to hit a closed account tomorrow! Please help me!!!!!!

No they can not go into your actual check. I thought you meant your checking account. They will try to hit your account because they do not know yet that it is closed. Have you spoken to your bank about not hitting you with fees, because of the theft. Once they find out they can not get your money they will begin to contact you.

Normally, they don't take money out of your check. They try to hit your bank account.

But - Once they realize that won't work, some of them will try a wage assignment. It's similiar to a garnishment, only it's not court ordered, and is completly voluntary. In some states wage assignments are illegal. Since they are voluntary, they are 100% revokable. All you have to do is send the company a letter stating "I herby revoke any and all wage assignments I may have signed with Company X." Keep a copy for your HR dept.

Other then the wage assignment, they would need a court order to touch your paycheck. Most illegal companies won't sue you, but there are some that will. Just be sure to answer any summons you receive in the timeframe it states, and you should be able to win any case they try to bring.

thanks guys! I am just scared! I have been through alot this week. My bank knows not to let anything through on that account. It is now closed due to theft. I want to pay these places back, unfortunately, i have nothing yet since it was all stolen and have been refunded yet. Do u think they will allow me to set up payment plans.....?

hey anyone ever heard of these places making pay arrangements for these debts? I would like to pay them off since i did borrow the money. How likely is it that I can make pay arrangements and they won't hassle me if I stand on those agreements?
