Ace Cash Express Loan Help Kansas

My husband has 12 in store payday loans that are all in default as of December 2007, our bank account is closed. We have made payment arrangements with all of them and they have all accepted the arrangements, except for Ace Cash Express. We have been paying Ace each month at their in store location and they have taken those payments. Our original loan was for 575.00 and we are down to 425.00 we still owe. They sent us to their in house collections immediately and they call all the time and are nasty and telling us our payments are mot acceptable, etc. Now they have sent our "case number" as they call it to their Recovery Unit as of March 1st and they have been calling constantly and are nasty as well. They told my husband today they were going to charge him with fraud and that since we haven't made acceptable payments they are going to get him for writing a bad check that since we defaulted on the loan and our payments are not acceptable, they can now transfer it to being a bad check and they are going to file our case on March The 14th if we don't pay the remainder of the balance and that we need to seek legal counsel. He also told them not to call his work and they said they can do as they please because now it is considered a bad check. Please let me know if this is true. We will get them paid ASAP just waiting for our tax money. We reside in Kansas. Thank you.


rok, I am so sorry to hear all of this. However, you are not alone. We've all been there. I went ahead and posted your state law regarding pdls. Notice, please, that where is says "criminal action" is says PROHIBITED. This means they can not take CRIMINAL action against you/your husband. They can take you to CIVIL court if that's what floats their boat. However, then most likely you would just end up making payment arrangements there. So, I honestly don't know why they don't just take your payment arrangments. Now, are they taking your payments each time you go in? Are they applying it directly to the amount that you owe? Are they adding extra fees on to it? Actually, they have been taking your payments for awhile so they can't claim you did not make an attempt to pay this loan off. Personally I think they're insane, but who am I? If it comes down to it, you/your husband can't be charged with a bad check. It specifically states in the storefronts that it will not be considered a "bad check" on a deferred payment loan. Like I said, they can take you to CIVIL court if they want to waste their time. Have you tried calling the corporate office of Ace? I've had luck with calling the corporate offices of storefronts and making arrangements with them.

Rok, If I may jump in here...I would also suggest you file with the Office of the State Bank Commissioner and with the BBB. Your state law says that criminal action is prohibited....you have been making payments to this company yet they turn you over to their collections and the collections company is threatening you. I would be sure to note all the dates and times they call, who you spoke to or left a message and note what was said. If it is legal in your state, I would record the calls. Hold them accountable for their behavior. The information for filing with your state is at the bottom of your state law post...the bbb is bbb.org. With the bbb try to use the corporate office address and reference the store address in your complaint. If you need help with any of this just post and we will be more than happy to help.

Yes, they are still taking our payments at the store location, although collections tell us over the phone that they won't accept them, they have so far. When we take a payment in they always put it towards what we owe and we get a receipt. I do write down everything they say and when they call, the folder is right next to our phone. Thankfully they have not added any extra fees. We can always count on a phone call from their collections saying it is not enough and we need to pay more not even an hour after we make the payment at the store and it continues at least twice a day. We always tell them when the next payment will be and have always made them on time. We were good customers for 2 years prior never missing a payments. I have not tried to call the corporate office, but will do so in the morning. We are trying as hard as we can to get everyone paid, it was never our intention to default on any of these, but after 2 years of rewriting them it just became too much to handle, so here we are. I have found almost all of the storefronts have been fairly easy to work with, we were not able to do the four equal payments since we have 12 pdl's but they have been willing to do smaller payments each month by just sending them letters and calling them after they received the letters letting them know our intent. Communication is the key to the storefronts I think with the exception of Ace. Never again will we get into this mess. Thank you so much to everyone for all of this valuable information, I feel lots better and truly appreciate it. Maybe we will be able to sleep tonight.

rok, you are doing everything right. Why they continue to call after you make your payments just blows my mind. Honestly. They're accepting your payments, you're getting receipts, etc. You need to contact their corporate office and ask them what the hell is their problem. I'm being serious. There is no reason to harrass you (which is what they are doing) while they are ACCEPTING your payments. Totally uncalled for. Please call their corporate office. See what they have to say about the repeated harrassment. And, please, keep us updated as to how it's going. And don't be shy about putting in complaints against these guys if you feel up to it.

Well just got off the phone with Ace corporate office. The number for corporate is the same number listed for their recovery unit, big joke, but worth a try anyway. Wouldn't let us speak to anyone else except our friendly case manager. Finally we talked to the big wig and he said the same thing as the the case manager. Said he would have rather we had made no payments, that they didn't give the loan in bits and pieces so why would they want it paid back in bits and pieces. He also told us they are filing the case today and to seek legal counsel. Tried to claim fraud because our loan was made in November and our bank closed our account in December. He also suggest we pay the total due and then rewrite the loan again. He also gave us 50.00 off the amount we owe if we zoom right in today and pay it off. If we had that kind of money we would pay it off. I guess we may be going to court it seems. Hope they make payment arrangements in court, or that we receive our tax refund before then so we can just get them paid and off of our backs. Thank you to everyone for all the useful information, I will keep you informed if we do indeed go to court over this.

rok, you have GOT to be kidding me. God, for whoever is reading this, please never use Ace Cash Express! They are insane! First of all, what they're trying to do (of course) is make you rewrite. That's their number one priority. Get the customer to rewrite so they get those fees every two weeks. Keep the customer in the cycle for years and years. It disgusts me. And I am also disgusted that the corporate office has this attitude. No wonder the store manager has this attitude. It comes right from the top. Why in the hell would they say they would prefer you didn't make ANY payments? How retarded is that? They're getting their friggin money back. rok, you are doing everything in your power. You are making an honest attempt at repaying this debt. If they decide to take you to CIVIL court, fine. So be it. Just make sure you go. And their threats are something that you should report. They can't get you for "fraud". They can't prosecute you CRIMINALLY in your state. These bone heads probably don't think you're aware of your laws. They're trying to scare the money out of you. Stand firm, rok. Keep taking the payments to the store as you have been. Keep getting receipts. If you do end up going to court, you will have documentation of your honest efforts. And, remember, it won't be criminal court. Please keep us updated. Man, these guys burn my a$$.
