freeze on checking account against payday loans
Date: Thu, 03/13/2008 - 08:27
I have contacted my bank and a freeze has been issued to my account but yet two transactions went through this morning, I put the freeze on yesterday before 2:00. I called the bank and the person that helped me told me that they could've been authorized before the freeze was put on. One I know did not ask for mone until 4:30 CST. My check goes into the bank tonight since I could not stop the direct deposit for this week so I have asked them if they will allow all the charges to go through in the morning and I am being told that even if they do go through, they will be credited back to me on the next business day. What good is the freeze if it does not stop the ACH debits? Thanks
Well....that's a tricky one. They are right about a few things.
Well....that's a tricky one. They are right about a few things. If the business that debited your account..ACH debit..got an authorization code before you put the freeze on the account, they are authorized to do the withdrawal. Like when you use a debit card, and the charge doesn't go through until your account is already overdrawn. The bank won't turn that away, because Visa has already given the merchant a code that says they promise to pay it. So, Visa demands payment from your account at the bank. BUT...here's the silver lining...if you have previously requested, hopefully in writing with certified mail, that this company stop debiting your account, and they did it anyway, you can do an unauthorized ACH claim at your bank. That would get you back the money plus any fees the bank charged you as a result of the transaction. I hope this helps. :)

Thanks for the answer. The bank states that they will refund the monies to my account but I am concerned since tomorrow I have about $1100.00 in fees coming out of my account and too late to stop the direct deposit so I am going to open a new account and have the direct deposit moved to it but I am scared that these places got authorization prior to the hold. I sent the letters yesterday after the I put the freeze on the account since this forum states that is the best way and it makes sense. Do you have any idea how long before these authorizations are being given for these loan companies? Thanks

I am in the same boat. They won't reason with me and take payments. They just keep debiting my account every two weeks. That money could go toward the loan but they dont seem to see it that way. Will a certified letter really work?
