The two I know for sure right now that aren't licensed are d/b/a's of MTE Financial, who are nasty, nasty, nasty. I'm checking on the others and not finding much, but I'm not done yet. Honestly, if you try to reason with these people, they will not listen to you. They will hit your account for all they can. You've already WAY, WAY, WAY overpaid all of these. Your best bet is to close your bank account. That's the only way to prevent these guys from debiting any more. They can be very ruthless. (c) Consumer's right to stop payment--(1) Notice. A consumer may stop payment of a preauthorized electronic fund transfer from the consumer's account by notifying the financial institution orally or in writing at least three business days before the scheduled date of the transfer.
(2) Written confirmation. The financial institution may require the consumer to give written confirmation of a stop-payment order within 14 days of an oral notification. An institution that requires written confirmation shall inform the consumer of the requirement and provide the address where confirmation must be sent when the consumer gives the oral notification. An oral stop-payment order ceases to be binding after 14 days if the consumer fails to provide the required written confirmation.
(d) Notice of transfers varying in amount--(1) Notice. When a preauthorized electronic fund transfer from the consumer's accounts will vary in amount from the previous transfer under the same authorization or from the preauthorized amount, the designated payee or the financial institution shall send the consumer written notice of the amount and date of the transfer at least 10 days before the scheduled date of transfer.
(2) Range. (e) Compulsory use--(1) Credit. KM, you really need to get your bank on board with you and get them to either close the account or place a hard debit block on the account so the pdls can not take any money out...if the pdls know you are closing your account...they have been known to debit the whole ammount you owe to be sure they get their money. If you have to, go in there and make them listen to you. Tell them you wallet was stolen or whatever you have to to get them to cooperate.

PDL licensing
Sorry to tell you sir but I called The Attorney General's Office in my state of Minn. and all PDL companies MUST be licensed to do business in the state of which the person taking out the loan resides. If they are not, in all actuality the loans are considered null and void. ALSO if they are to pursue legal action against you they must also do so in the state where you reside. ( as in all legal matters) The bottom line if you cannot afford to take out theses loans then don't because almost all of them are fraudulent in some way and many are not licensed to do business in your state. People don't know the facts and this is why they get away with the shady things they do. Stay educated on this and keep a close eye on any and all your bank accounts every day. There is a 1,000 fine per tranaction for these PDL's and anyone working on thier behalf such as a collection agency for violating the fdcpa rules and regulations. It might take a while but out government is going to fix this mess and many state governments already are.
Overpaying PDL loans
My god people how in the world can these companies do this? We all keep the actual copy of our original loan agreement and on it it clearly states how much the loan was, how much the interest and how much the payments. And to top it off we all have access to our bank recordes of all transactions so how the hell can these companies dispute what is/is not owed with all this paper trail? They do these things because so many of us are too busy in our lives to keep on top of our accounts and the activity within them. It is so sad they are so fraudulent. Fight fire with fire. Call them and let them know you are going to file complaints with every gov. agency who will listen in your state as well as theirs and eventually they will be stopped. I know people who are working on legislature as I type to put an end to all this crap.
