I received a phone call at work today. The man said that he was from US National Bank. He said that I owed on a payday loan from 2005. I only had taken out two loans in 2005, but I paid them back. He says that I owe 350.00. I asked for documentation.He said,they can give anything in regards to this matter. Just pay the money. I don't want to pay because I do not have any proof of this loan. He has threaten to come and have me arrested. What should I do? This is not the first time I received a call like this. I received another one two weeks ago with the same thing. Something is not right and I need some advice. Thank you


You are within your rights to request documentation, and it was wise to make that request. In fact, I????????m pretty sure that if a creditor cannot verify your debt you are not required to pay it. (Do I have that right? Does anyone know?)

I do know it is a violation of the fdcpa to threaten jail time. This person is breaking the law. I would recommend familiarizing yourself with the law (the Fair Debt Collection Practices Act) and avoid paying this debt until you receive verification. In the meantime, don????????t worry about getting arrested. There are no debtors???????? prisons in this county. Even if you do end up owing the debt you cannot be thrown in jail for not paying it.

The FTC is a great place to start.

There is no such thing as US National bank. It is a collection agency trying to trick you! There are at least a half dozwn threads on here about them. Do a search above and you will learn much! You can sue them for that and there are many lawyers that would take it on a contingency basis. Keep a record and tape them if you are permitted in your state!
