Help -with Blatt Hasenmiller Leibsker
Date: Tue, 03/18/2008 - 16:07
Live in Illinois..and got a letter from Blatt, Hasenmiller Leibsker stating they are representing Midland Credit. They are trying to collect $3200.
Apparently Orchard sold this account to Household who then sold it to Midland.
The orig. card had a credit line of $800, now the amount they are showing owed is $3200.
Household first sent this to Blitt, another attorney's office in Sept. 2008. I sent Blitt a debt validation letter and never received a response. Since then Household apparently sold it to Midland.
(btw--No, the statute of limitations has not run out-my last payment to Household was in April of 2004)
The Blatt, Hasenmiller Leibsker office (from all I have read here) has a bad rep for unethical practices.
I am leery to deal with them directly.I am prepared to send them a debt validation letter, but am concerned that they will in that time try suit me or get a judgment entered against me during the time they are to be trying to validate the debt.
THREE QUESTIONS
1) What are my best options?
2) Does anyone know a good attorney in Illinois who might be of help with this?
3) Will the request for debt validation only make this matter worse? One lawyer I called today who suggested sending them a letter with a payment offer/plan...he did not seem to think a debt validation letter was a good idea???
Thanks for reading this. Please reply if you can.

I would send them a DV, myself. It may well provoke a lawsuit. I
I would send them a DV, myself. It may well provoke a lawsuit. If it does, ask for validation in discovery. They still need to prove they're the right people to pay, etc.
