Florida Has Extra Help Against Collectors

This information is for Florida residents who are experiencing harassment by debt collectors. Aside from the fdcpa which most of us are familiar with that applies to third party collectors only, Florida has FS 559.72 which, while paralleling the FDCPA in having the same basic content, it is broader and also applies to all collectors not just third parties. One section prohibits unreasonable frequency of calls in an attempt to harass, a common but overlooked violation committed with frequency by collectors. This can be calling everyday and hanging up or leaving multiple voice mail messages as well as making frequent contact.
I hav an attorney right now who has filed suit on this violation. He is so confident of winning he takes these cases on a contingency basis. If you are a Florida resident who is being harrased by collectors please PM me and I will be glad to refer you to him.
Payday lenders in the past thought that they were not subject to collection laws because they were the original lender. In Florida they are dead wrong and can be sued for threatening, harrassing and every other tactic they are well known for!

Thanks for pointing this out, as it could be really helpful to those of us in Florida. I think I had mentioned it before in a post a while back, but it definitely bears repeating. I think the name of it is "The Florida Consumer Collection Practices Act", or something like that. The statute even advises if their is a discrepancy/conflict between the fdcpa and FCCPA, whichever is more protective of the consumer's rights takes precedence.

Whaddaya know, Florida finally passed a law to actually help it's residents! Go figure. Now if we could just get some laws passed to protect employees in the state of Florida, things might get a little better here.

Oh, and finally get an election right, too!

I wish I had known about this law a while back, when that credit card company kept calling my job and filling up my voice mails with their messages while I was out on medical leave. When I told them to stop, they advised they would just keep on calling me. I would have sued their behinds right then!

Also, another interesting thing. When I called the Florida's AG's office the other day to ask them about SOL's, I happened to mention the name "Legal Mediation Practice" to them. I was advised they are already aware of LMP and their shenanigans, and are going to be looking into them. She advised me to have everyone file complaints on the FL AG's website, if they have had problems with LMP. Even if they are not a resident of Florida.

See. The wheels of justice might move slow, but the do eventually move.
