2 agencies collecting on one debt

I've gotten letters from 2 collection agencies trying to collect on the same debt. I sent both validation letters & have gotten no response. Is there a limitation on how long they have to respond? How can 2 agencies collect on the same account?


Hi Carol--

The simple answer is, they cannot. Well, they cannot legally, anyways. The only way for this to happen would be one of the following two:

1--a debt buyer owns the debt and is assigning more than one CA at the same time to collect on it, which I personally would consider harassment. I think that you would have a strong case there for harassment as an fdcpa violation, to be honest.

2--at least one of these CAs is fraudulently trying to collect on this debt.

Either way, some funny business is going on. Perhaps you should consider contacting the AG's office in your state and explain this to them, see what they say about it.
