I did a stupid thing in that I sent off my house payment early so it would get there on time. Instead of deposting my check as they usually do, they ran it through the day they got it. I had money in the bank to cover the checks I thought would come through, but it left me $500 overdrawn. To make a long story short, I have about $400 worth of overdraft charges on all the small checks which came through last night.
I do not have the money to go in and rewrite the checks that were due today. One I have to pay $460 and I cannot rewrite the second check for two days....these were the ones I had to wait on while I paid off a couple. That money that I have left will have to stay in my account for other checks/payments I wrote.
None of those checks are on my new account, so if they send them through it will just come back to them.
I had not anticipated this happening until I could get the amount I was paying others on a paydown done.
What should I do? Tell them to send the checks through if they must, try to work something out as it is the day they are due?

Just to be SURE and don't whip me too hard here Cannr for bein' paranoid...thought maybe it might be different in this state...I called the Sheriff's office and talked to the Magistrate (might be a learning experience to shae with other's, no?) and HE told me not to sweat it, yes if things progressed they might issue a warrant, but I should tell them if that is what they must do, do it. He said it is a *slap* and they will not arrest me. Then I go to Civil court if I do not pay it off in the mean time? He siad to be cool and offer them $20 or $30 a week, even.
So what advantage do they have to threaten me? I mean does it make them feel better. The CE woman said I owe her a lot of money, after all. I have paid them $120 a month religiously for years on this loan...oh...I forgot, I pay it off and rewrite every other week so it is a *new* loan? But let us just imgine...$60 x 12 mos.=$720 x 3 yrs....I cannot recall... is $2160 - $330....ah..$1830 profit for them?

Let me just tell you "why" they threaten you - because you are attempting to get out of they cycle of paying and rewriting and paying and rewriting and paying those friggin fees every two weeks. This is BONUS money to them each month. The more people they have writing checks, the more money in their pocket. If they lose a good customer (and you did the math), they're out that amount of money just from ONE person (you). Also, by making payments, they're not getting their "full amount" (and another rewrite), so it's less money in their pocket at the end of the month. What it boils down to is BONUS MONEY for the storefront managers each month. This is why they try to force people to rewrite. Now, we already knew that CRIMINAL action is prohibited in your state. That's why I was saying don't stress yourself over it too much. I know you're going to anyway; however, it'll work out. Like the sheriff told you, if they feel as though they must "swear out a warrent" (which the wording just doesn't jive here), then tell them to do what they gotta do. Whatever gives them a thrill. The most that will happen is you go to civil court. Not criminal court. No, you did not write a "bad check on a closed account". No. It's posted in every legal storefront in the states where criminal prosecution is prohibited that is it not considered a "bad check" when entering into an agreement with them. It is posted on their wall. It has to be by law. What I can't quite understand is why the hell the ones that are members of the CFSA are giving you such a hard way to go. They should not. And, actually, I would file a complaint with the CFSA against them, as they are not following the guidelines that they are supposed to. I honestly can not, for the life of me, figure out why they are being so retarded about all of this. Hell, when they turned my checks in (because they said they had to turn them in to the bank), they came back "account closed". I was a little worried, but not a whole lot. And what did they do? They set up payment arrangements with me. Period. Yes, I was turned over to corporate on a couple of them; however, I just made payments to them. I made payments to one storefront who just held my check and I went in and paid. And one I had was a member of the CFSA and I just went in and invoked the EPP and paid them off. Yes, they tried to force me to pay and rewrite - wouldn't do it. So, they turned me over. Fine. It worked out better because I didn't have to deal with the a$$hole storefront managers. Why they want "two payments" is beyond me. Well, then again, it goes back to the whole "bonus money" issue, I guess. egypt, the worst that can happen (and it may not) is you would have to show up in civil court. Okay, fine. You will then make payment arrangements. So, that's why it KILLS me that storefronts pull this kind of crap. Pay these guys whatever you can. Like the sheriff said, if it's $20 or $30, so be it. You're making an honest attempt. Keep records of every payment. Keep records of every conversation these idiots have with you (their threats). Just in case you do end up in civil court, you will have some documentation to take with you. If you can't pay these people the amounts they are asking, take what you can. If they refuse your payment, fine, leave and make note of it. Cover your butt. Now, they might be just trying to scare money out of you. They like to do that. It may never go to civil court. It might just end up being these guys turning you over to collections. It could all be just a scare tactic. Whatever. Just do what you can, your sheriff gave you good advice, keep documentation, and just be prepared for the worst (which is only civil court). You will not be arrested and charged with "bad check". Nope. Not in your state. You do know that I am just STEAMING here at how your storefronts are treating you. I wish I was near you. I'd LOVE to go to the storefront with you.

I have had two places actually three that have not thrown a fit...one I have not paid as they said they would send the checks through I am going to have to call them, However I paid them 120 a month for maybe 10 years? I would be surprised if they had the courage to tell me how much I owe them. And they are a small place, not CFSA?
BUT on the bright side...the one that is /was $460 is now....ta da...$115? In just a few weeks...one more payment and they are history.

I did not meet with the woman from CIC...I will just tell her to either set up those payments as is, send the check through, but that I will not rewrite on a closed account. Another person I told I was going to set up payments on the next check as we reviewed their policy...again...it will buy me some time to pay the others off. Two are not even aware that I will be defaulting, although I have. I still spent $120 with those I am not ready to do anything with YET.

I did send off an e-mail to the man I know who works for Dave Ramsey and he confirmed everything we have talked about here, but because I know him so well I told him I was asking for advise for a friend? At that, I do not think he is as adept at handling this type of debt as those on this Forum. But he stressed to communicate with these folk just like Cannr says to do.

I do not know what it will take or how much time and anxiety I will be going through, but I do know that I am getting out from under this plaque.

Never, never will I forget the sleepless nights, the anxiety upon waking every morning, the thought of "what's going to go wrong now", the dread of dealing with these people, etc. Oh, it was horrible. I would sit at work and honestly, the only thing on my mind was money, debt, pdls, etc. I was zoned out in my own world. It was sick! Slowly though, the light started coming! It was pretty damn dark and ugly in the beginning. Now I'm amazed that I don't have to (like you even stated) drive around to all the different storefronts paying and rewriting, fighting internets pdls, etc. I can actually come HOME after work on payday instead of driving all over town. I can actually get on my email and not have 100 messages from friggin internet pdls. I can check my bank account and damn the money is still there! You, too, will be to this point. You are working hard at it and it'll pay off. Then you won't know what to do with yourself once you've got it all taken care of! LOL!

Yesterday, I talked to a girl who used to work with one of the companies and I asked her if they will take payments and she said yes and gave me the name of the corporate people to contact as she says the regional will not help me much at all.

As for your question regarding the storefronts suing you (no) for having more than the limit the state law allows, do not be afraid. I was SCARED TO DEATH. I thought my a$$ was in big trouble because I had too many loans out, I lied when asked 'do you have any other payday loans out', etc. Man, I thought I was going to jail! No. Do not worry about it. How many thousands of people do this every week? I can't even count that high. Just deal with them one by one. They won't "gang up" on you. They probably don't even know you have loans out with other storefronts. They're just concerned with THEIR loan. Don't fret over this. They're actually trying to pass a law in my state now that all the storefronts have to have some kind of database to check and see if people have loans out with other storefronts. I think that would be AWESOME because that would prevent people from doing what we did (getting too many) and finding ourselves in the situation of not being able to pay them. Hell, egypt, these storefronts know that 98% of the people that come in there for a loan say "I don't have any other loans" and yes, they do. That's why they have you inital saying you don't. It just kind of covers their butt. But, no, they're not going to gang up and get you. If that were the case, they would have come knocking on my door and dragging me away!

THis site save me in so many ways and I remember the desperation I felt when I made that first post...my life has completely changed and I have been helping one of my coworkers who in up to her eyeballs in storefronts. She has not done anything about them yet...but she is starting to see the light. I thought myslef the biggest looser in the world until I found I was not alone and accepted the fact that I made mistakes that I needed to fix. It certainly helps to share the burden. SOmetimes, I still feel out of my element with the technical stuff, but I know that even if I can not answer those questions, the moral support is just as important.

Now I've come to realize that "okay, I can't pay this out of this check or I'll be poor, so I'll pay it out of my next check". I now go out and get my gas, buy some groceries, then go through my bills and figure out what ones need to be paid RIGHT NOW and which ones can wait a week. You can do it. You already realize that you need to make some modifications. That's the first step! egypt, this whole process is going to be a learning experience for you. Anything you can get that will help your $20 grow it really nice, but even if you just have it stashed in a savings account with .5-1% interest, you've got $$ in savings!! :D

I am really panicky today as I just realized that by the time I pay my car note and electric and phone bill I will not be able to get anything to any of these PDL people...even the last $115 I had to pay the ones that arranged a paydown. The companies are calling every day now and I still have not gotten a letter off to them I had one company expecting $100 and another expecting $165. I can make neither.
I am not sure what to do now. I can't even afford to buy the ink for the printer to get these letters done.

I just got a call from the Check Into Cash woman who I told that the account was closed, who said many do have a closed account and as *long as they do not know about it*, they can continue. Well today she called and said the bank told her the account was still open and the funds are available. I told her that was impossible, because it had been closed. I asked her what account number she had given them and she told me the old one...I told her other members of our family had an account so perhaps it was a mistake.
Then I called my bank and spoke with the gal who assisted me with closing the account. She reassured me that it was closed and that they will put not to give out the account info to anyone.
I think she is pressuring me into giving out my new account info.? How do you think she knows I have a new account? She says she cannot do a paydown unless the account is current, which requires a new account and check?

Hey Egypt, Goudah is totally right take care of your living expenses first. I know exactly how you feel, that panicky feeling. It usually sits in the pit of my stomach and I just get so scared that it will never go away. I still have that feeling with my PDL situation, but I do know from experience with other things in my life when I have had that feeling, it does go away. Things do get better. And I have to believe that things will get better in this situation also, if I don't believe that I would go completely crazy. That's all I just wanted you to know you are in my thoughts!
