They are now calling me threating to take me to court for bad check. I was just wondering if they are lying. I tried to work out payment arrangments with them but I can not afford what they are offering. I am thinking that if they do send it to a collection agency I can work out smaller arrangements with them. However I am not sure if the actually will file or just send it to a CA

DO NOT ever be afraid of any of these PDL"s taking you to court. If that were to happen the first thing they would have to produce is thier licensing to practice in YOUR state and believe me they don't have it. That is a tactic they use to intimidate you. The simplest thing to do is change your bank account number to a different account. That way even though they have your SSN thay still cannot get access to your new account.

I can't wait, for the other shoe to drop and they all get sucked into a big black hole out there somewhere. Chin up. All will be okay. Go back and read some of my posts about a month ago, I too was scared to death. Now, I could care less about them. I'd like to see them try to explain the whys and wherefores of exactly what we are doing in court. I still have four that I am duking it out with and I really don't give them the time of day, except for when I read and/or post on here. Smile, you're not alone.

Yes, this is a STOREFRONT pdl. Before giving advice regarding closing/changing bank accounts, we need to have ALL information. Not all pdls are internet. The storefronts have a physical check in their hand from the person. We would need to check on the laws to see what kind of action can be taken, as some states do allow criminal prosecution! So, before giving advice regarding bank accounts, please, please make sure all the necessary information is on the post. Perfect example. Where is says "criminal action" is says "not specified". So.... we don't know what can happen. ACE, from what I've read, are hard a$$e$. They might well not be "lying" about taking someone to court for a bad check. With it being "not specified", we need to tread carefully here. Some storefronts will just send it to collections; however, they obviously have the right to take it to court. My advise? Call the storefront, speak to the manager, and ask for a payment plan. If they refuse, ask them what steps they are going to take since you are unable to pay it in full. If you don't get anywhere with the storefront manager, call the corporate office. Ask them what steps they take regarding defaulted loans.
