My Date of First Delinquency as per my credit report shows 2/2004 on a debt for a credit card. I received a summons today which is 3/25/08. The state I live in (TX) has a 4 year statue of limitations. Am I correct in the fact that it is now past the statue and I cannot be sued?


Yeah, right the Statues of Limitation in Texas is 4 years and according to the information provided by you the debt has surpasses the legal time period. If so then you are no longer legally liable to repay the loan. However, you may wait to hear what the other members have to say in this matter.
