The process is you contact the collector and send him a big fat check. Then maybe monthly payments can be worked out if you send a reasonable amount. You will lose in court and have your bank account and assets attached and you paycheck will be garnished. You will be immediately be branded "LOSER" by your human resources department.

Also , there are some states that dont even allow garnishments. NNC does not have a clue.

Who is suing you?
a) If it is a collection agency did you send a debt validation letter to make sure that they are legally able to collect this debt?

Did you actually receive a court summons?
Did you check with the court to make sure this is a real suit? (Sometimes sleazy agents will get court papers and send them out without filing with the court).

Most important you might lose in court but you will not be left destitute. The court will make sure that you pay a FAIR AND REASONABLE amount on a monthly plan. The court understands that you have to be able to live so they will not take everything you got and give it to the Collector.

I spoke with a laywer in regards to this. I live in PA so there is noe wage garnishment. Also because my wifes name is on everything there is no property to place a lien on. If they get a judgment, all they get is proof I owe the debt. All they can do is hurt my credit, but its already hurt, and I am working on rebuilding it.

Make sure you show up in court. Many states have mediation to prevent judgements. Monthly payments can be worked out at that time. Call the clerk of the court and ask what to expect before you go.

here is what happened to my fiance. We got into credit card debt under him. We started paying one off settle for less that got taken care of then came Wash Mutal and we sent them a big check for 3000.00 then right after they recieved that they sent is stuff saying that they are sueing us. So he filed bankruptcy. I know not the best ending. We had every intention of paying them back we just hit a really hard time.

That no nonsense collector has no sense. He/she is evil and hateful....and lies to worry people about olddebts.

I wouldn't even consider backruptcy. I have alot of accounts that I am still in good standing with and never been late. I can deal with 2 accounts. Like I said even if they did get a judgment there is nothing they can do except say i owe them money. I have contacted the laywer for the firm and going to meet to see if we can work something out.
