I have a payday loan out for $300.00 (I have no idea what it is now with the fees and whatever). However it is 4 months old. I made one payment and then my mother died and left a mess and now I am finding myself in a bankruptcy situation. Anyrate. I just got a call from a Mr White at Payday Loan Yes, very rude and threatening. I told him repeatedly do not call me at work and hung up, he called back! He threatened that he would call my boss and call the Sherrifs dept to have me arrested. I wasn't going to put them under my bankruptcy as I knew I owed the money, but I am so mad at them so I think I just will. My question is, can the keep calling me at work after I have told them not to and can they have me arrested & is the loan dischargeable under bankruptcy Ch 7? He said it was fraud and bad checks, I never wrote any checks to post dated any. I asked him for his phone number and he wouldn't give it to me, I told him how was I supposed to call him back if he didn't give me his number, he relented and gave it to me (800) 654-7444 ext 822 then I asked for his address and very rudely said he would not give it to me and told me "look it up yourself" and that he was calling the local sheriffs department right now. He said the reason he would not give me the address is they do not accept mailed payments. I told him I would not give him my checking account number. I closed the original account and have made repayment arragements with my old bank as it was negative due to the NSF fees. I hung up on him. Please Help! I am scared.

classic scare tactic.one it is not a check,you didn't give them an actual check.two they can't have you arrested for not paying a pdl.these are just scare tactics.what state are you in again?

They cannot have you arrested. It is a scare tactic. Do not fall for it and yes put them on your bankruptcy...do it first for that matter. Then have your attorney call them. You can sue for harassment once they receive a letter from your attorney as far as I know.
