I have 9 pdls and can not seem to get rid of them i live in tn and all are online pdls i get rid of one and have to get two to help with the bills and now i am a month behind on my mortgage, please help


went to bank and closed my account. assured me that when account is closed nothing can go thru or force open that account, and if something tries to come thru that is not listed they will call me
so now what do i do?
i have a number for stcadvance.com it is 18006801357
can anybody help with this one.
when do i contact the bbb about the illegal ones and what do i do about the legal ones because i do plan one paying the money i need help on what to do next please.

JOnna, Good job with the account...I went and read your new post to and am going to post here to keep all your information on one thread. Go back and read through your thread...Cannr outlined your next steps. I am going to give you a link to a sample letter you can tailor to fit your needs. If you need help with it just ask. You will have to scroll down the page to find it. I posted the information on filing on one of the earlier pages...

Now...using this letter you will write a letter to each pdl. The ones you have to work out payment plans, you will tell them how you are going to pay them, how much and when. When you mail the letter send it certified return receipt. If you want you can fax it and e-mail it too.

do i need to tell the legal ones that am trying to keep my house or do you think that they just don't care?
how do i know when it is safe the debits are scheduled for 04/04/08 to come out
and the legal ones do i just need to tell them that the bank closed my account. and need to make other arrangments for payment?

It's not like i'm not going to pay, i did borrow the money, i am willing to pay it back.
should i wait until after friday to send the letters to make sure that the debits don't come out, my bank assured me that they would not, i'm not sure when i need to send the letters to the illegal ones as well as trhe legal ones

I sure would not send out the letters until the bank has definitely closed your account. I would call the bank tomorrow and make sure it is closed. Call it paranoia.
I intend to repay all of mine, but have had one set back after another since I started to do this....I figure they will get what I can send them or else.
I have had one or two companies be civil but the rest are mad that they are not going to get my money every other week.
I am going to sit down and make out a budget to make sure I am not committing to more than I can afford and go from there.

jonna, you're doing fine so far, okay? The illegal pdls that you're going to send the letter to, wait until you know your bank account is totally closed/blocked and nothing can hit it any longer. Once you are sure the bank account is safe, then send the letters. In the meantime, you can start typing them up with all the information needed in them.That way, they will be ready to go on Friday or Saturday. Wait until Monday to call your legal pdls. You'll know your bank account is safe, and you can tell them THE BANK closed your account. Tell them the bank closed it, okay? Then tell them you will need an alternative way to make payments to them. They will have to work with you because they have no other way to get payment since they can't debit any more. Deny having a bank account. You don't want them to debit, okay? You can pay another way. Work out a payment plan with them that you can honestly live with. You can tell them your situation, if you wish. Some will work with you, others will not. It just depends on the pdl. But try to stand strong. You can put your illegal ones on the "backburner" for just a bit if your account is safe from them. Concentrate on the legal ones first, since they are legal. But wait until you know for sure that your bank account is closed. If you have any questions, just post!

You can file complaints with the bbb whenever you are ready. You can file on the legal ones as well, especially if you are making attempts to pay them and they are making things difficult. They will most likely say you knew what you were doing when you signed for the loan, but atleast the complaint will be on record for others to see. With the BBB you can file a complaint on a legitimate business. I never used them before my pdls issues, but have used them on several occasions, non pdl related, and it worked out well in my favor.

If they are out of Ireland they are no going to be licnesed. You will need to file on them with the FTC.

Cannr posted this in reference to the phone number and that is what I found as well.


Honestly, I would wait for them to contact you. Maybe we will be able to get more iformation once they contact you.

jonna, these three pdls are all MTE related pdls. There is NO REASON the BBB will not accept your complaints. I have filed complaints against many of MTE's d/b/a's. I have never had a problem with them. What exactly are they saying to you regarding filing complaints against them? Do you not have enough information on them? Let us know what they are telling you and we may be able to help you out.

I am glad i found this thread. I had posted a thread of my own but wasnt getting a response....here is what I posted before....

have 6 count them 6 loans out all 300 with 90.00 every 2 week fees. I have put a block on ACH on my bank account so they cant debit any $ out here is the list below

I work and live in Tennessee but I still hold a WV drivers license and address there because that is my permanent residence. My question is I took these loans out with my mailing address in TN where storefront PDL's are legal. I spoke to the TN state finace dept and they are currently trying to stop internet loans but told me to file a complaint and little else. They agreed that the terms break TN check laws but said there is no real statute for internet loans but he agreed it he thinks it is wrong. My question is in WV these are hands down illegal is it possible to just tell them that these are illegal in my home state? I just cant afford all these loans and it is unlikely that they will allow for pay plans. I dont want them calling my work or people I know. I know they cant put me in jail or anything like that but I jsut dont want the emabarrassment.

jelsmith, you took out the loans using your TN address. So, you have to stick with TN. You can't claim WV since you didn't use WV as your address. Your bank account is blocked, correct? So no one can debit your bank account. That's the first step. Now, you need to file complaints with the BBB, the FTC, and your state AG (you're going to have to use the TN AG). File your complaints against each company. Also, have you sent the pdls any kind of letter regarding no longer debiting your account, they are not licensed to lend, etc?

no I wasnt sure if any of these are illegal lenders like not licensed. I put a hard block (blanket block) on ach so no debits can go through. my other question is about garnishments does anyone know if a pdl company can just garnish wages? I thought you had to have a judgement from a court to do that?

Okay, first of all, I'm going to post the TN state pdl law for everyone to see. Also, in addition to the TN pdl law, here is some information regarding internet lending as far as TN is concerned that goudah researched:




What this means is that we need to check your lenders out. If they are licensed SOMEWHERE, they will be considered "legal" and you would have to abide by the state pdl law in which they are licensed.

Also, regarding garnishment, pdls can't "garnish" wages. Yes, you're correct, they would have to get a court order to do that. However, some plds will try to pull a wage "assignment" on you, which it totally voluntary and can be revoked at any time. Looking at your lenders, none of them jump out as ones that pull wage assignments. However, we do have a letter that you can send your pdls regarding not debiting your account, not contacting you via telephone, etc. But, we first need to see who (if any) are licensed SOMEWHERE and figure out which ones will be considered legal and which ones will be considered illegal.

What we'll need to do is find out where the pdls are located (I usually start with the BBB site to find their addresses). Once I find an address, I go to that particular state and check out the licensee database and see if they are licensed there. To check each state pld law and licensee database, you can go to: paydayloaninfo.org. You can go to state information, it'll give you the pdl state law and then there is usually a link on it saying licensee database. You can type in the name your looking for and see if they are indeed licensed in that state.

Someone will correct me if I am wrong regarding any of the above ones listed.

However, do you have more information on Sagamore and Zip19? Address? Phone number? Do you have your loan documents from them? If so, can you see if they have an address or if they state where they claim the law is "governed" by? If I can get more information on them, I can look them up. Or someone may come along and know! :wink:
