Ok I owe 4 Payday loans 2 with MTE Financial d/b/a PayCheckToday $200 princ $60 in fees. I paid $50 on the princ and $90 in fees the balance now is $150 princ/$45 in fees. MTE d/b/a quickest-cash-advance $300 prin $90 in fees paid $0 so far. Paydayone $650 princ $185 in fees paid $0 so fae, B.I.G Int $225 prin $80 in fees paid $0 so far. I know that MTE and B.I.G is totally illegal, I just discovered that through this site today. So far i have closed my checking account and gotten a new account with the same bank. I read the post on hear about closing your account. I called my bank and they said that the accounts are not linked but if an ACH come through in the next 48-72 hours it will force the account open and an NSF will occur but i can submit a claim to recoup the fees. Also I faxed and Emailed MTE letter revoking electronic debit and letters not to call me at work. I told them they could email or call my home or cell... but not at work. I put the Tennessee code in the letters regarding EFT REG E and Fair Debt coll. Act and how i am in my right to make this request. I wish I would have read this post yesterday. I would have said they can only contact via email. but its cool for cell and home numbers those number only allow the people on my calling list to get through everyone else will go straight to voice mail... my phone wont even ring for a person whos not on my calling list. I'm also going to take letters to my bank stating that these PDL are not allowed to debit my new account and give them copies of the letter i sent to the PDL's although the PDL have no idea what my new account number is;.. i feel better safe than sorry. I have the contact information for Tennessee Atorney General and Tennessee Department of Financial Institution al though i dont know what to say, it may be still to early because no have contact me yet because my payments are not due yet. I know these guys cant do anything to me but annoy the hell out of me...I think Paydayone is legal in Deleware so I may have to deal with them... i want to know what else do i need to do next. The payment for MTE and BIG will come due 4/4/08. Im going to go ahead and pay off BIG through moneygram cause i dont feel like dealing with any fools in another country. should i send a more officical cease and desist letter. I just sent on that i made up on my own. I sent the letter via fax and email. Should i send it certified mail as well. So far no calls from them yet. I pretty much did this before any payment came due i wanted to have all this in place first and kind of beat them to the punch. Oh yeah I already stop my payroll direct deposit and rerouted that to my visa card which no one has any information on, where should I go from here. i really would appreciate some sound advice. Trying to prepare for battle by staying 1 step ahead of them.. help desprately needed.


Hang in there kd. You have a lot of questions and I am fairly new here myself. From what I am gathering it would appear that you are going in the right direction but like I said, I am not sure about the "legal" things that you need to know. The people on here are great and they will advise you accordingly. Someone should be along soon to help you out with this.

Okay, kd. Your MTE pdls are illegal. Your BIG pdl is illegal. PayDayOne is licensed, so it would be considered legal for you. So.... you already sent a letter to the plds? To all of them? You can send the MTE and BIG pdls the "you are illegal" letter. You can fax and email it, like you did. However, it's always best to also try to send it via certified mail just so that you have documentation. Your "legal" pdl, you will have to contact and make an alternative payment arrangement with. They'll most likely work with you. MTE and BIG will be a bear to deal with. They are soooo annoying. And they lie, lie, lie. You're headed in the right direction so far. Just make sure you contact your legal pdl to make alternative payment arrangments other than ACH debit of your bank account. Do not let anyone know you even have another bank account. Just claim you no longer have one. No more debiting. As far as filing complaints, file with the BBB, the FTC (especially on BIG), and your state AG. You don't have to say anything "fancy". Just state the facts. Tell them they are illegal companies doing business with you, blah, blah, blah. And, yes, go ahead and file now. You don't have to wait until you hear from the pdls. They are illegal. File the complaints. It really does sound as though you're on the right road here. If you have any questions, just post!
