My husband and I live in SC and we were wondering what we can do. Arrowhead Investments are using a company called PDM (Phenoix debt management) to collect money owed to them. I have bank statements proving that I have already paid over $1000 on a $300 loan. PDM is threatening to garnish my husbands wages to pay back $468 for the loan. What do we do?Can they do that?


Are we discussing about a pdl here?? Please clarify, so that we can look into the State laws regarding the pdls.

Anyways, first thing first, send a DV letter to the CA and ask them to reply back in writing. They may take sometime in replying back, during this period DO NOT get into any negotiation with them.

2ndly, no CA is allowed to use threats like-garnishing wages or getting judgment, untill and unless they actually have the plan to do so. Its a violation of fdcpa.

Are they debiting your bank account for the payments? If so, you'll need to close that account and open a new one at a different bank. You'll then need to send them a letter/email revoking their right to debit your account. Please read this first, though.

Is this an online PDL, or a storefront? [Sorry, I'm not the PDL expert, but I did stay at a Holiday Inn once.]

Now, on them garnishing your husband's wages, that's crap. They can't garnish without a court order, and I'd be extremely surprised if they could get one of those.

It sounds to me like you're paid with these folks, but getting them to understand that may be a long process. There's much expert help available on our payday loan help forum. I would urge you to take advantage of it.
