Keep changing Collection agencies

Is it ok to assume that if a debt is 4 years old and everytime that I send a proof of debt to the collection agency they sell it off to another CA, that they don't have the sufficient information to sue. It's been through like 5 different collection agencies.


If you've DV'ed 5 different CAs on the same debt without so much as an attempt at validation, then, yes. They likely don't have the materials [or access to them] to validate. That does not mean that they can't sue on the account. They can, and it would be up to you to answer, and ask for validation in discovery. If they can't produce it, then you could move that the case be dismissed.

Lemme ask you some questions, if I may... Who are the agencies involved? What kind of debt are we talking about here, and when's the last time you made a charge or payment on it? And what state do you live in? With the answers to those, I can give you more complete information.

Thank you for the reply. The CA is an attorney's office out of Chicago. They are the current collector. The debt is a Citibank credit card and the last time I made a payment on it was I believe early in 2004. I might add that the current collector just bought the debt from a collector in California. I just sent them a debt validation letter and haven't received a response yet.

I have a question pertainign to all of this. If you have 2 or 3 DIFFERENT CA's that 'owned' your debt, and you're not sure which one actually 'owns it now, should you send a DV letter to ALL of them?

Hi, WULF. No...I haven't sent DV letters to ALL of them. It seems like when I want to try make arrangements, with ONE of them, the 'account' is sold and I have ANOTHER CA takes its place. GOSH!!...they ( CA's) do this awfully fast!!
