Hello Everyone.
I currently am going through bankruptcy because someone I became involved with 10 payday loans that I do not recall signing up for in the least bit. They actually overwithdrew my checking account almost 2,000 in the bankruptcy but my bank was not accommodating. They bounced the scheduled ACH debits back to them and I have not been paying since I have seen my lawyer. First, since my bank was not at ALL helpful it looks like I have written a whole slew of bad checks right? Some of the payday loans were sent to collection.. But will I get arrested because of this? Also, I saw that some of the addresses were in the Bahamas for the payday loans.. I am super concerned because I am going to the Bahamas on a cruise soon. I am deathly afraid that they will arrest me or take me into custody there somehow for NOT paying their loan back. Will someone please respond and help me out with this? Thanks.


Brook, I am sure you will be safe on your cruise. We can help you get through all this. Please tell us what state you are in, which companies you borrowed from, how much you borrowed from each and the total of what was paid back to each. We also need to know whether the loans were storefront or internet. Also, if you did not apply for any of the loans, and someone else did in your name, that is illegal and you need to report this as identity theft.

I am from Pennsylvania.
I am currently filing for BK and I am just scared that someone will come after me soon.

There are probably 3 more. I only paid the first one or two payments before they started bouncing back to them because it was like thousands a month on this. My lawyer just said.. quit paying let it bounce do whatever. I have since switched lawyers and this has been a really long process. Still in the making.

please dont be offended but did you not also receive the money from the 10 ipdl's that you allegedly do not recall signing up for? I hope your bankruptcy attorney told you that you run a high risk of not being able to include these ipdls in your bankruptcy if they were new debt incurred within the past 90-days.

I signed up for ONE and the next day I had 5 and then a couple days later 3 more. I figured that I had gone through one of those sites that just match you up with the payday loans. Big mistake. He told me that payday loans are a joke and basically they are illegal anyway so if you never pay them back no one generally cares anyway because they are in so much trouble as it is. But still.. I need to hear from other people involved with them.

Brook, Here are the laws for your state....

What this means to you is that internet lenders can lend legally to PA residents as long as they are licensed in another state. They would need to follow the laws of the state in which they are licensed.

Brook, you mentioned some were sent to collections? Which pdls and which collection agencies were they sent to...also is you bank account now closed?

So far the only one I know off the top of my head that is going to be licensed is CashNet USA. There are one or two that we will need to look up. Also, when you can, will you please post how much you borrowed from each and the total of how much you have paid back to each. And we need you to try to go back through you bank statements to figure out if there are any more...you said there may be three more.

Brook, This means there are no storefronts in PA becuase they are illegal. Since Cashnet is legal you will need to determine if you are/can include that in your bankruptcy and if not, you will need to contact them and payment arrangements with them. Brook, if you are going to stick around awhile to work on this you should considering registering.

ALSO, I do know that one of my payday loans I believe is based in the Bahamas.. I am going there in May. I am so afraid I will have to show ID and be detained or something insane. I am really scared and almost not even excited about my trip anymore. Am I overreacting?

Speaking from experience here as I went to the bahamas via a cruise last year (and going again this year), the Bahamian authorities do not require you to show ID when getting off of the boat. Once you have your "cruise ID" when you get on the ship, you are cleared. Everyone will need to complete a Bahamas "tourisim form" which just asks for your name, why you are in the bahamas and your email address. You give these to your cabin steward.
