Gang, I've been reading about the EPP. I'm in Ohio and think this is the way for me to go. I will have to do one at a time, but once its done its done. My question is, I notice most of the posts about the EPP say, that it goes by your states laws, I know what the OHIO PDL laws are, but where would I find info about the EPP in Ohio. Also, I see I need to contact the lender the day before the loan is due, do I have to pay that day? As that is the day before pay day and I won't have the money to start the payments until payday. Also, I have one internet loan with CashNet USA, will they do a EPP? Thanks Reny


I don't know much about how the individual EPP laws vary from state to state, but I can say something based on my experiences ( CA ).

I think that no matter where you are located, call ahead or stop in the store at least a few days before your loan is due and before you default it. ( I say a few days because I don't know, some might pull one of those "3 working business days" things on you ). In my case, most of my storefronts needed me to come in the day before my loan was due, and one of them needed me to come in on the exact day it was due. So find out ahead of time before you default.

In my case, I was asked if I wanted to make my first payment on the day I was starting the EPP, or if I wanted to start payments 2 weeks from then, on my next payday. I know I have read at least one person's post somewhere on here saying that they were required to make the first payment the very day they asked for the EPP. So once again, find out first so that you will be completely prepared.

CashNet USA is one of the few licensed internet lenders, and their home page shows the CFSA logo. It states in their FAQ that if you are unable to pay your loan or the loan extension, you must contact them to set up payment arrangements.

I've had numerous loans in the past with CashNet USA but have never defaulted with them nor set up any kind of repayment plan with them, so your best bet is to call them and find out, unless somewhere here has had experience working on one with them that can tell you.

CFSA Best Practices and Guidelines for Extended Payment Plans
Subject to applicable state laws, each member shall provide an Extended Payment Plan (???????EPP???????) for customers who are unable to repay a loan. The member shall adopt a plan that offers the customer at least the following provisions:

You [the customer] may opt into an EPP to pay an outstanding loan if you are unable to repay your loan when due. Any outstanding fee will be included in the amount subject to EPP.

You must invoke the EPP by close of business on the last business day before the loan due date by returning to the office where you obtained the loan or by using whatever method you used to obtain the loan. To invoke the EPP, you must sign an amendment to your loan agreement reflecting the new payment schedule.

You may pay the transaction balance in four equal payments coinciding with your periodic pay dates.

We will not begin collection activities while you are under an EPP as long as you meet all obligations under the EPP.

There is no charge for you to enter into an EPP. However, if you default on an EPP, we may charge you an EPP fee and accelerate payment on the balance remaining, as authorized by applicable law.

lmale, I recently evoked the EPP at a storefront (It's paid off now woooo! I am also in Ohio. When I signed up for the payment plan I had to make the interest payment that day, then I made the rest of my payments on each payday. That could vary from store to store, but that was how it worked for me. Good luck! :)
